Hukuk Dairesi Ba\u015fkanl\u0131\u011f\u0131 Esas no: 2021\/897 Karar no: 2021\/5272<\/span><br><span class=\"large\"><\/span><br><span class=\"large\"> <strong>YASAL DAYANAK <\/strong><\/span><br><span class=\"large\"><\/span><br><span class=\"large\"> 4857 say\u0131l\u0131 kanunun 56\/5. maddesinde \u201cY\u0131ll\u0131k \u00fccretli izin g\u00fcnlerinin hesab\u0131nda izin s\u00fcresine rastlayan ulusal bayram, hafta tatili ve genel tatil g\u00fcnleri izin s\u00fcresinden say\u0131lmaz\u201d h\u00fckm\u00fc amirdir.<\/span><br><span class=\"large\"><\/span><br><span class=\"large\"> <strong>\u0130\u015e\u00c7\u0130N\u0130N TALEB\u0130<\/strong><\/span><br><span class=\"large\"><\/span><br><span class=\"large\"> \u0130nceleme konusu Yarg\u0131tay karar\u0131nda; davac\u0131 vekilinin talebi \u015f\u00f6yle kayda girdi: \u201cDavac\u0131 m\u00fcvekkil, \u2026\u2026 tarihinden itibaren daval\u0131 nezdinde \u00e7al\u0131\u015fm\u0131\u015ft\u0131r, sendika \u00fcyesidir ve toplu i\u015f s\u00f6zle\u015fmesi (T\u0130S) kapsam\u0131ndad\u0131r. T\u0130S\u2019te pazar g\u00fcn\u00fc hafta tatili, cumartesi g\u00fcn\u00fc de akdi tatil olarak d\u00fczenlenmi\u015ftir. Bununla birlikte, \u0130\u015f Kanunu\u2019nda y\u0131ll\u0131k izin s\u00fcresinden say\u0131lamayacak g\u00fcnler i\u00e7inde hafta tatili g\u00fcnleri de say\u0131lm\u0131\u015f, T\u0130S kapsam\u0131nda cumartesi g\u00fcnlerinin de hafta tatili oldu\u011fu ve y\u0131ll\u0131k izin s\u00fcresinden d\u00fc\u015f\u00fclmesinin m\u00fcmk\u00fcn olmad\u0131\u011f\u0131 kaydedilmi\u015ftir. Dosyada, davac\u0131n\u0131n yasal \u00e7al\u0131\u015fma s\u00fcresini haftal\u0131k 5 g\u00fcn \u00e7al\u0131\u015farak doldurdu\u011fu, bu nedenlerle toplu i\u015f s\u00f6zle\u015fmesinde \u2018dinlendirme g\u00fcn\u00fc\u2019 olarak akdedilen cumartesi g\u00fcnlerinin, akdi tatil olmas\u0131 sebebiyle y\u0131ll\u0131k izin s\u00fcresinden d\u00fc\u015f\u00fclemeyece\u011finin tespitine karar verilmesi talep edilmi\u015ftir.\u201d<\/span><br><span class=\"large\"> <strong><\/strong><\/span><br><span class=\"large\"> <strong>\u0130\u015eVEREN\u0130N CEVABI<\/strong><\/span><br><span class=\"large\"><\/span><br><span class=\"large\"> \u0130ncelemeye konu olayda daval\u0131n\u0131n cevab\u0131 ise \u00f6zetle \u015f\u00f6yle: \u201cDaval\u0131 vekili, 2429 say\u0131l\u0131 yasada ulusal bayram ve genel tatil g\u00fcn\u00fc ile hafta tatili g\u00fcnlerinin neler oldu\u011funun a\u00e7\u0131k\u00e7a d\u00fczenlendi\u011fini yazd\u0131. Yasada hafta tatilinin pazar g\u00fcn\u00fc oldu\u011fu belirtildi, \u0130\u015f Kanunu\u2019nun 46. ve 63. maddesinde haftal\u0131k \u00e7al\u0131\u015fma g\u00fcnleri ve hafta tatilinin a\u00e7\u0131k\u00e7a d\u00fczenlendi\u011fi, yasaya g\u00f6re 6 g\u00fcn \u00e7al\u0131\u015fan i\u015f\u00e7iye haftan\u0131n yedinci g\u00fcn\u00fc verilen 24 saatlik iznin hafta tatili oldu\u011fu, sendika ile yap\u0131lan toplu i\u015f s\u00f6zle\u015fmesinde de haftal\u0131k \u00e7al\u0131\u015fma s\u00fcresinin 45 saat oldu\u011fu, vardiyal\u0131 \u00e7al\u0131\u015fma yok ise hafta i\u00e7i 9\u2019ar saat mesai yap\u0131laca\u011f\u0131, cumartesi g\u00fcn\u00fc i\u015f\u00e7ilerin dinlendirilece\u011fi ve pazar g\u00fcn\u00fcn\u00fcn de hafta tatili oldu\u011fu yaz\u0131ld\u0131. Gerek yasada gerekse toplu i\u015f s\u00f6zle\u015fmesinde cumartesi g\u00fcn\u00fcn\u00fcn hafta tatili oldu\u011funa dair d\u00fczenleme yoktur. Davan\u0131n reddini talep ediyoruz.\u201d<\/span><br><span class=\"large\"><\/span><br><span class=\"large\"> <strong>NASIL YAPILACAK?<\/strong><\/span><br><span class=\"large\"><\/span><br><span class=\"large\"> Yarg\u0131tay 9. Hukuk Dairesi\u2019nin bu konuyla ilgili karar\u0131nda ise \u015f\u00f6yle denildi: \u201cYarg\u0131tay 22. Hukuk Dairesi\u2019nin kapat\u0131lmas\u0131 sonras\u0131nda <\/span><span class=\"large\">Ba\u015fkan ve \u00dcyelerinin Yarg\u0131tay 9. Hukuk Dairesi\u2019nde g\u00f6revlendirilmesi \u00fczerine her iki daire kararlar\u0131nda uyu\u015fmazl\u0131k konusu hususlar g\u00f6r\u00fc\u015f\u00fclm\u00fc\u015f ve b\u00f6ylelikle bir\u00e7ok konuda uygulaman\u0131n birle\u015ftirilmesine karar verilmi\u015ftir. Bu konular aras\u0131nda, hafta tatili g\u00fcn\u00fc olarak kararla\u015ft\u0131r\u0131lan cumartesi g\u00fcn\u00fcn\u00fcn y\u0131ll\u0131k izin hesab\u0131nda nas\u0131l de\u011ferlendirilece\u011fi sorunu da ele al\u0131nm\u0131\u015f ve burada, 4857 say\u0131l\u0131 \u0130\u015f Kanunu\u2019nun 46. ve 63. maddelerine g\u00f6re hafta tatili haftal\u0131k 45 saatlik \u00e7al\u0131\u015fmadan sonraki 24 saatlik bir g\u00fcnd\u00fcr. Bu nedenle kural olarak cumartesi i\u015f g\u00fcn\u00fcd\u00fcr. Akdi tatil g\u00fcn\u00fc olarak cumartesi g\u00fcnleri y\u0131ll\u0131k izin s\u00fcresine eklenmez. Ba\u015fka bir anlat\u0131mla, cumartesi g\u00fcnleri akdi tatil g\u00fcn\u00fc olarak i\u015f\u00e7i \u00e7al\u0131\u015fmad\u0131\u011f\u0131 takdirde y\u0131ll\u0131k \u00fccretli izin s\u00fcresine ili\u015fkin hesapta hafta tatili olarak de\u011ferlendirilemez. Cumartesi g\u00fcn\u00fc hafta tatili olarak da kararla\u015ft\u0131r\u0131labilir. <\/span><br><span class=\"large\"><\/span><br><span class=\"large\"> Bireysel veya toplu i\u015f s\u00f6zle\u015fmeleriyle cumartesi ve pazar g\u00fcnleri hafta tatili g\u00fcn\u00fc olarak belirlenmi\u015fse, \u0130\u015f Kanunu\u2019nun <\/span><span class=\"large\">56\/5. maddesi gere\u011fi her iki g\u00fcn y\u0131ll\u0131k izin s\u00fcrelerinden say\u0131lmaz. Ba\u015fka bir anlat\u0131mla y\u0131ll\u0131k izin kullanma d\u00f6nemi i\u00e7indeki cumartesi ve pazar g\u00fcnleri kullan\u0131lan izin s\u00fcresinden d\u00fc\u015f\u00fcl\u00fcr. Ancak bireysel veya toplu i\u015f s\u00f6zle\u015fmesinde hafta tatiline eklenen bu cumartesi g\u00fcn\u00fcn\u00fcn y\u0131ll\u0131k izin hesab\u0131nda i\u015f g\u00fcn\u00fc olarak say\u0131laca\u011f\u0131 veya izin s\u00fcresinden d\u00fc\u015f\u00fclmeyece\u011fi \u015feklinde a\u00e7\u0131k bir kural mevcutsa, bu h\u00fck\u00fcm ge\u00e7erli say\u0131lmal\u0131 ve \u0130\u015f Kanunu\u2019nun 56\/5. maddesi gere\u011fi sadece y\u0131ll\u0131k izne rastlayan pazar g\u00fcnleri izin s\u00fcresinden d\u00fc\u015f\u00fclmelidir. Buna g\u00f6re i\u015f\u00e7inin haftada ikinci bir g\u00fcn hizmet akdi veya toplu i\u015f s\u00f6zle\u015fmesi ile \u00f6rne\u011fin cumartesi g\u00fcn\u00fc de hafta tatili olarak kabul edilmi\u015f ise y\u0131ll\u0131k iznin kullan\u0131m\u0131nda aynen pazar g\u00fcn\u00fcn\u00fcn hafta tatili say\u0131lmas\u0131 gibi bu ikinci hafta tatili g\u00fcn\u00fc de \u00f6rne\u011fin cumartesi g\u00fcn\u00fc senelik izin s\u00fcresinden say\u0131lmayacak. B\u00f6ylece i\u015f\u00e7inin kullanaca\u011f\u0131 senelik izin s\u00fcresi artabilecek. <\/span><br><span class=\"large\"> <strong><\/strong><\/span><br><span class=\"large\"> <strong>S\u00d6ZLE\u015eMEDE A\u00c7IK\u00c7A YAZILMALI<\/strong><\/span><br><span class=\"large\"> <strong><\/strong><\/span><br><span class=\"large\"> \u0130\u015f\u00e7i ve i\u015fverenlerin, gereksiz ihtilafa d\u00fc\u015fmemeleri i\u00e7in cumartesi ya da di\u011fer bir g\u00fcn\u00fcn ikinci bir hafta tatili say\u0131l\u0131p say\u0131lmayaca\u011f\u0131n\u0131 aleni bir \u015fekilde hizmet akdi ya da sendikal\u0131 i\u015fyerlerinde toplu i\u015f s\u00f6zle\u015fmesinde yer vermeleri gerekiyor. <\/span><br><span class=\"large\"><\/span><br><span class=\"large\"> <strong>\u00d6RNEK HESAPLAMA<\/strong><\/span><br><span class=\"large\"><\/span><br><span class=\"large\"> Karara konu olan hususu somut bir \u00f6rnekle izah edecek olursak; 15 g\u00fcn senelik izin talebinde bulunan bir i\u015f\u00e7i i\u015f yerinde pazar g\u00fcn\u00fc ile birlikte cumartesi g\u00fcn\u00fc de hi\u00e7bir duraksamaya mahal vermeden a\u00e7\u0131k\u00e7a hizmet akdinde hafta tatili olarak yer verilmi\u015f olmas\u0131 halinde, 3 hafta izin yapm\u0131\u015f olan i\u015f\u00e7i, toplam 21 g\u00fcn \u00e7al\u0131\u015fmad\u0131\u011f\u0131 halde 15 g\u00fcn senelik izin kullanm\u0131\u015f say\u0131lacak. Yasada hafta tatilinin pazar g\u00fcn\u00fc oldu\u011fu belirtildi, \u0130\u015f Kanunu\u2019nun 46. ve 63. maddesinde haftal\u0131k \u00e7al\u0131\u015fma g\u00fcnleri ve hafta tatilinin a\u00e7\u0131k\u00e7a d\u00fczenlendi\u011fi, yasaya g\u00f6re 6 g\u00fcn \u00e7al\u0131\u015fan i\u015f\u00e7iye haftan\u0131n yedinci g\u00fcn\u00fc verilen 24 saatlik iznin hafta tatili oldu\u011fu, sendika ile yap\u0131lan toplu i\u015f s\u00f6zle\u015fmesinde de haftal\u0131k \u00e7al\u0131\u015fma s\u00fcresinin 45 saat oldu\u011fu, vardiyal\u0131 \u00e7al\u0131\u015fma yok ise hafta i\u00e7i 9\u2019ar saat mesai yap\u0131laca\u011f\u0131, cumartesi g\u00fcn\u00fc i\u015f\u00e7ilerin dinlendirilece\u011fi ve pazar g\u00fcn\u00fcn\u00fcn de hafta tatili oldu\u011fu yaz\u0131ld\u0131. Gerek yasada gerekse toplu i\u015f s\u00f6zle\u015fmesinde cumartesi g\u00fcn\u00fcn\u00fcn hafta tatili oldu\u011funa dair d\u00fczenleme yoktur. Davan\u0131n reddini talep ediyoruz.\u201d<\/span><br><span class=\"large\"><\/span><br><span class=\"large\"> <strong>NASIL YAPILACAK?<\/strong><\/span><br><span class=\"large\"><\/span><br><span class=\"large\"> Yarg\u0131tay 9. Hukuk Dairesi\u2019nin bu konuyla ilgili karar\u0131nda ise \u015f\u00f6yle denildi: \u201cYarg\u0131tay 22. Hukuk Dairesi\u2019nin kapat\u0131lmas\u0131 sonras\u0131nda <\/span><span class=\"large\">Ba\u015fkan ve \u00dcyelerinin Yarg\u0131tay 9. Hukuk Dairesi\u2019nde g\u00f6revlendirilmesi \u00fczerine her iki daire kararlar\u0131nda uyu\u015fmazl\u0131k konusu hususlar g\u00f6r\u00fc\u015f\u00fclm\u00fc\u015f ve b\u00f6ylelikle bir\u00e7ok konuda uygulaman\u0131n birle\u015ftirilmesine karar verilmi\u015ftir. Bu konular aras\u0131nda, hafta tatili g\u00fcn\u00fc olarak kararla\u015ft\u0131r\u0131lan cumartesi g\u00fcn\u00fcn\u00fcn y\u0131ll\u0131k izin hesab\u0131nda nas\u0131l de\u011ferlendirilece\u011fi sorunu da ele al\u0131nm\u0131\u015f ve burada, 4857 say\u0131l\u0131 \u0130\u015f Kanunu\u2019nun 46. ve 63. maddelerine g\u00f6re hafta tatili haftal\u0131k 45 saatlik \u00e7al\u0131\u015fmadan sonraki 24 saatlik bir g\u00fcnd\u00fcr. Bu nedenle kural olarak cumartesi i\u015f g\u00fcn\u00fcd\u00fcr. Akdi tatil g\u00fcn\u00fc olarak cumartesi g\u00fcnleri y\u0131ll\u0131k izin s\u00fcresine eklenmez. Ba\u015fka bir anlat\u0131mla, cumartesi g\u00fcnleri akdi tatil g\u00fcn\u00fc olarak i\u015f\u00e7i \u00e7al\u0131\u015fmad\u0131\u011f\u0131 takdirde y\u0131ll\u0131k \u00fccretli izin s\u00fcresine ili\u015fkin hesapta hafta tatili olarak de\u011ferlendirilemez. Cumartesi g\u00fcn\u00fc hafta tatili olarak da kararla\u015ft\u0131r\u0131labilir. <\/span><br><span class=\"large\"><\/span><br><span class=\"large\"> Bireysel veya toplu i\u015f s\u00f6zle\u015fmeleriyle cumartesi ve pazar g\u00fcnleri hafta tatili g\u00fcn\u00fc olarak belirlenmi\u015fse, \u0130\u015f Kanunu\u2019nun <\/span><span class=\"large\">56\/5. maddesi gere\u011fi her iki g\u00fcn y\u0131ll\u0131k izin s\u00fcrelerinden say\u0131lmaz. Ba\u015fka bir anlat\u0131mla y\u0131ll\u0131k izin kullanma d\u00f6nemi i\u00e7indeki cumartesi ve pazar g\u00fcnleri kullan\u0131lan izin s\u00fcresinden d\u00fc\u015f\u00fcl\u00fcr. Ancak bireysel veya toplu i\u015f s\u00f6zle\u015fmesinde hafta tatiline eklenen bu cumartesi g\u00fcn\u00fcn\u00fcn y\u0131ll\u0131k izin hesab\u0131nda i\u015f g\u00fcn\u00fc olarak say\u0131laca\u011f\u0131 veya izin s\u00fcresinden d\u00fc\u015f\u00fclmeyece\u011fi \u015feklinde a\u00e7\u0131k bir kural mevcutsa, bu h\u00fck\u00fcm ge\u00e7erli say\u0131lmal\u0131 ve \u0130\u015f Kanunu\u2019nun 56\/5. maddesi gere\u011fi sadece y\u0131ll\u0131k izne rastlayan pazar g\u00fcnleri izin s\u00fcresinden d\u00fc\u015f\u00fclmelidir. Buna g\u00f6re i\u015f\u00e7inin haftada ikinci bir g\u00fcn hizmet akdi veya toplu i\u015f s\u00f6zle\u015fmesi ile \u00f6rne\u011fin cumartesi g\u00fcn\u00fc de hafta tatili olarak kabul edilmi\u015f ise y\u0131ll\u0131k iznin kullan\u0131m\u0131nda aynen pazar g\u00fcn\u00fcn\u00fcn hafta tatili say\u0131lmas\u0131 gibi bu ikinci hafta tatili g\u00fcn\u00fc de \u00f6rne\u011fin cumartesi g\u00fcn\u00fc senelik izin s\u00fcresinden say\u0131lmayacak. B\u00f6ylece i\u015f\u00e7inin kullanaca\u011f\u0131 senelik izin s\u00fcresi artabilecek. <\/span><br><span class=\"large\"> <strong><\/strong><\/span><br><span class=\"large\"> <strong>S\u00d6ZLE\u015eMEDE A\u00c7IK\u00c7A YAZILMALI<\/strong><\/span><br><span class=\"large\"> <strong><\/strong><\/span><br><span class=\"large\"> \u0130\u015f\u00e7i ve i\u015fverenlerin, gereksiz ihtilafa d\u00fc\u015fmemeleri i\u00e7in cumartesi ya da di\u011fer bir g\u00fcn\u00fcn ikinci bir hafta tatili say\u0131l\u0131p say\u0131lmayaca\u011f\u0131n\u0131 aleni bir \u015fekilde hizmet akdi ya da sendikal\u0131 i\u015fyerlerinde toplu i\u015f s\u00f6zle\u015fmesinde yer vermeleri gerekiyor. <\/span><br><span class=\"large\"><\/span><br><span class=\"large\"> <strong>\u00d6RNEK HESAPLAMA<\/strong><\/span><br><span class=\"large\"><\/span><br><span class=\"large\"> Karara konu olan hususu somut bir \u00f6rnekle izah edecek olursak; 15 g\u00fcn senelik izin talebinde bulunan bir i\u015f\u00e7i i\u015f yerinde pazar g\u00fcn\u00fc ile birlikte cumartesi g\u00fcn\u00fc de hi\u00e7bir duraksamaya mahal vermeden a\u00e7\u0131k\u00e7a hizmet akdinde hafta tatili olarak yer verilmi\u015f olmas\u0131 halinde, 3 hafta izin yapm\u0131\u015f olan i\u015f\u00e7i, toplam 21 g\u00fcn \u00e7al\u0131\u015fmad\u0131\u011f\u0131 halde 15 g\u00fcn senelik izin kullanm\u0131\u015f say\u0131lacak.
