Belirtilen i\u015flerde yap\u0131lacak uygulamalar, 27 Temmuz 2021 tarihinde yap\u0131lan de\u011fi\u015fiklikler \u00e7er\u00e7evesinde bu yaz\u0131m\u0131zda de\u011ferlendirildi.<\/span><\/p>  <p><span class=\"large\"><strong>EN FAZLA 6 AY<\/strong><\/span><\/p>  <p><span class=\"large\">4857 Say\u0131l\u0131 \u0130\u015f Kanunu\u2019nda, nitelikleri gere\u011fi g\u00fcnl\u00fck ve haftal\u0131k \u00e7al\u0131\u015fma s\u00fcrelerinin, di\u011fer i\u015flerde \u00f6ng\u00f6r\u00fcld\u00fc\u011f\u00fc \u015fekilde uygulanmas\u0131 m\u00fcmk\u00fcn olmayan i\u015f ve i\u015fyerlerinde g\u00fcnl\u00fck yasal \u00e7al\u0131\u015fma s\u00fcresini a\u015fmayacak \u015fekilde ve en fazla 6 aya kadar denkle\u015ftirme s\u00fcresi tan\u0131narak uygulanmas\u0131n\u0131 sa\u011flayacak usullerin, \u00c7al\u0131\u015fma ve Sosyal G\u00fcvenlik Bakanl\u0131\u011f\u0131nca haz\u0131rlanacak y\u00f6netmeliklerle d\u00fczenlenece\u011fi h\u00fckme ba\u011fland\u0131.<\/span><\/p>  <p><span class=\"large\">Di\u011fer yandan, nitelikleri dolay\u0131s\u0131yla durmaks\u0131z\u0131n birbiri ard\u0131na i\u015f\u00e7i postalar\u0131 \u00e7al\u0131\u015ft\u0131r\u0131larak i\u015fletilen yahut n\u00f6betle\u015fe i\u015f\u00e7i postalar\u0131 ile yap\u0131lan i\u015flerde, \u00e7al\u0131\u015fma s\u00fcrelerine, hafta tatillerine, gece \u00e7al\u0131\u015fmalar\u0131na ve \u00e7al\u0131\u015fma ortas\u0131ndaki zorunlu dinlenmelere dair \u00f6zel usul ve esaslar\u0131n da an\u0131lan Bakanl\u0131k\u00e7a haz\u0131rlanacak y\u00f6netmeliklerle d\u00fczenlenece\u011fi h\u00fckme ba\u011fland\u0131. Bakanl\u0131k\u00e7a haz\u0131rlanan y\u00f6netmelikte belirtilen i\u015flerin y\u00fcr\u00fct\u00fclece\u011fi \u00e7al\u0131\u015fma d\u00f6nemi, i\u015fin niteli\u011fine g\u00f6re, en fazla 6 ay\u0131 ge\u00e7memek \u00fczere i\u015fveren taraf\u0131ndan belirlenebilecek.<\/span><\/p>  <p><span class=\"large\"><strong>\u00c7ALI\u015eMA S\u00dcRES\u0130<\/strong><\/span><\/p>  <p><span class=\"large\">Bir \u00e7al\u0131\u015fma d\u00f6nemindeki \u00e7al\u0131\u015fma s\u00fcresi, bu d\u00f6nem i\u00e7indeki hafta say\u0131s\u0131n\u0131n, haftal\u0131k \u00e7al\u0131\u015fma s\u00fcresi \u00e7arp\u0131m\u0131 sonunda bulunan miktar\u0131 a\u015famayacak. \u00c7al\u0131\u015fma s\u00fcresinin haftalara tam b\u00f6l\u00fcnemedi\u011fi hallerde, \u00e7al\u0131\u015fma s\u00fcresi i\u015f g\u00fcn\u00fc \u00fczerinden ve her i\u015f g\u00fcn\u00fc 7.5 saatlik i\u015f s\u00fcresi kabul olunmak suretiyle hesaplanacak.<\/span><\/p>  <p><span class=\"large\">Kapsama giren i\u015flerde bir \u00e7al\u0131\u015fma d\u00f6nemi i\u00e7indeki haftal\u0131k i\u015f s\u00fcresi, 45 saatten az ya da \u00e7ok olarak belirlenebilir. Ancak kararla\u015ft\u0131r\u0131lan \u00e7al\u0131\u015fma d\u00f6nemindeki \u00e7al\u0131\u015fma s\u00fcresinin bir i\u015f haftas\u0131na d\u00fc\u015fen ortalamas\u0131 45 saati ge\u00e7emeyecek.<\/span><\/p>  <p><span class=\"large\">Yo\u011funla\u015ft\u0131r\u0131lm\u0131\u015f i\u015f haftas\u0131 veya haftalar\u0131ndan sonraki d\u00f6nemde i\u015f\u00e7inin daha az s\u00fcrelerle \u00e7al\u0131\u015ft\u0131r\u0131lmas\u0131 suretiyle toplam \u00e7al\u0131\u015fma s\u00fcresinin, \u00e7al\u0131\u015fmas\u0131 gereken toplam normal s\u00fcreyi ge\u00e7meyecek \u015fekilde denkle\u015ftirilmesi gerekiyor.<\/span><\/p>  <p><span class=\"large\"><strong>EN SON YAPILAN DE\u011e\u0130\u015e\u0130KL\u0130K<\/strong><\/span><\/p>  <p><span class=\"large\">27 Temmuz 2021 tarihinde yap\u0131lan y\u00f6netmelik de\u011fi\u015fikli\u011fiyle g\u00fcnl\u00fck \u00e7al\u0131\u015fma s\u00fcrelerin uygulanmas\u0131nda;g\u00fcnl\u00fck i\u015f s\u00fcresi 11 saati, gece \u00e7al\u0131\u015fma s\u00fcresi 7.5 saati ge\u00e7emeyecek. Ayr\u0131ca profesyonel ve a\u011f\u0131r vas\u0131ta ehliyeti ile ta\u015f\u0131t kullananlar\u0131n g\u00fcnl\u00fck \u00e7al\u0131\u015fma s\u00fcresi 9 saati ge\u00e7emeyecek. Ancak bu s\u00fcre herhangi bir hafta i\u00e7inde iki kez 10 saate \u00e7\u0131kar\u0131labilecek.<\/span><\/p>  <p><span class=\"large\"><strong>VER\u0130LECEK MOLALAR<\/strong><\/span><\/p>  <p><span class=\"large\">G\u00fcnl\u00fck ve haftal\u0131k \u00e7al\u0131\u015fma s\u00fcrelerinin di\u011fer i\u015flerde \u00f6ng\u00f6r\u00fcld\u00fc\u011f\u00fc \u015fekilde uygulanmas\u0131 m\u00fcmk\u00fcn olmayan i\u015f ve i\u015fyerlerinde \u00e7al\u0131\u015fan i\u015f\u00e7ilere de 4857 Say\u0131l\u0131 \u0130\u015f Kanunu\u2019ndaki esaslara uygun olarak ara dinlenmesi verilmesi gerekiyor. Buna g\u00f6re;<\/span><br><span class=\"large\"> 4 saat veya daha k\u0131sa s\u00fcreli g\u00fcnl\u00fck \u00e7al\u0131\u015fmalardaaradinlenmesien az 15 dakika<\/span><br><span class=\"large\"> 4 saatten fazla ve 7.5 saatten az \u00e7al\u0131\u015fmalar i\u00e7in en az yar\u0131m saat ve<\/span><br><span class=\"large\"> G\u00fcnl\u00fck 7.5 saati a\u015fan \u00e7al\u0131\u015fmalar bak\u0131m\u0131ndan ise en az bir saat aradinlenmesiverilmesi zorunlu. Bu s\u00fcreler, verilmesi gereken en az s\u00fcrelerdir.<\/span><\/p>  <p><span class=\"large\"><strong>FAZLA \u00c7ALI\u015eMA HESABI<\/strong><\/span><\/p>  <p><span class=\"large\">Bahse konu i\u015flerde fazla \u00e7al\u0131\u015fma, bir \u00e7al\u0131\u015fma d\u00f6nemindeki \u00e7al\u0131\u015fma s\u00fcresinin d\u0131\u015f\u0131nda yap\u0131lan \u00e7al\u0131\u015fmay\u0131 ifade ediyor. Bir \u00e7al\u0131\u015fma d\u00f6nemi i\u00e7inde, izinli veya raporlu bulunmalar\u0131 veya i\u015fe yeni ba\u015flamalar\u0131 ya da i\u015ften ayr\u0131lmalar\u0131 nedeniyle tam olarak \u00e7al\u0131\u015famayan veya i\u015fyerindeki zorlay\u0131c\u0131 nedenlerle tam olarak \u00e7al\u0131\u015ft\u0131r\u0131lamayan i\u015f\u00e7ilerin fazla \u00e7al\u0131\u015fmalar\u0131, o d\u00f6nem i\u00e7inde \u00e7al\u0131\u015ft\u0131klar\u0131 g\u00fcn say\u0131s\u0131na g\u00f6re hesaplan\u0131yor.
