Her ne kadar davac\u0131 \u015firkete ait i\u015fyerinin istasyon b\u00f6l\u00fcm\u00fcnde \u00e7al\u0131\u015fan i\u015f\u00e7ilerin ara dinlenme kullanmadan ve i\u015fin ba\u015f\u0131ndan ayr\u0131lmadan \u00e7al\u0131\u015ft\u0131klar\u0131 taraf tan\u0131klar\u0131nca belirtilse de her \u015feyden \u00f6nce, \u00fc\u00e7l\u00fc vardiya sisteminde 8 saatlik zaman diliminde zorunlu ihtiya\u00e7lar nedeniyle en az yar\u0131m saatlik ara dinlenmesi yap\u0131ld\u0131\u011f\u0131n\u0131n kabul\u00fc gerekmektedir. Zira ara dinlenmenin mutlaka i\u015fyeri d\u0131\u015f\u0131nda kullan\u0131lmas\u0131n\u0131n aranmamas\u0131 gerekti\u011fi dikkate al\u0131nd\u0131\u011f\u0131nda, daval\u0131 i\u015f\u00e7ilerin fazla \u00e7al\u0131\u015fma \u00fccretine hak kazanacak \u015fekilde fazla \u00e7al\u0131\u015fmas\u0131 bulunmad\u0131\u011f\u0131 g\u00f6r\u00fclmektedir. Kararda; i\u015f\u00e7ilerin ara dinlenme kullanmadan ve i\u015fin ba\u015f\u0131ndan ayr\u0131lmadan \u00e7al\u0131\u015ft\u0131klar\u0131 taraf tan\u0131klar\u0131nca belirtilse de her \u015feyden \u00f6nce, \u00fc\u00e7l\u00fc vardiya sisteminde 8 saatlik zaman diliminde zorunlu ihtiya\u00e7lar nedeniyle en az yar\u0131m saatlik ara dinlenmesi yap\u0131ld\u0131\u011f\u0131n\u0131n kabul\u00fc varsay\u0131ld\u0131. Her ne kadar davac\u0131 \u015firkete ait i\u015fyerinin istasyon b\u00f6l\u00fcm\u00fcnde \u00e7al\u0131\u015fan i\u015f\u00e7ilerin ara dinlenme kullanmadan ve i\u015fin ba\u015f\u0131ndan ayr\u0131lmadan \u00e7al\u0131\u015ft\u0131klar\u0131 taraf tan\u0131klar\u0131nca belirtilse de her \u015feyden \u00f6nce, \u00fc\u00e7l\u00fc vardiya sisteminde 8 saatlik zaman diliminde zorunlu ihtiya\u00e7lar nedeniyle en az yar\u0131m saatlik ara dinlenmesi yap\u0131ld\u0131\u011f\u0131n\u0131n kabul\u00fc gerekmektedir. Zira ara dinlenmenin mutlaka i\u015fyeri d\u0131\u015f\u0131nda kullan\u0131lmas\u0131n\u0131n aranmamas\u0131 gerekti\u011fi dikkate al\u0131nd\u0131\u011f\u0131nda, daval\u0131 i\u015f\u00e7ilerin fazla \u00e7al\u0131\u015fma \u00fccretine hak kazanacak \u015fekilde fazla \u00e7al\u0131\u015fmas\u0131 bulunmad\u0131\u011f\u0131 g\u00f6r\u00fclmektedir.
