MUHAMMET AKSAN<\/strong><\/span><\/p>  <p><span class=\"large\">Ki\u015fisel Verilerin Korunmas\u0131 Kurulu taraf\u0131ndan, \u201c\u0130lgili ki\u015finin aidat borcu bilgisinin site y\u00f6netimi taraf\u0131ndan ev sahibine iletilmesi\u201d hakk\u0131nda verilen 29 Eyl\u00fcl 2020 tarih ve 2020\/755 say\u0131l\u0131 kararda, s\u00f6z konusu \u015fik\u00e2yet hakk\u0131nda kanun kapsam\u0131nda yap\u0131lacak bir i\u015flem bulunmad\u0131\u011f\u0131na karar verilmi\u015ftir.<\/span><br><span class=\"large\"><\/span><br><span class=\"large\"> <strong>\u015e\u0130K\u00c2YETE KONU OLAY <\/strong><\/span><br><span class=\"large\"><\/span><br><span class=\"large\"> \u0130lgili ki\u015fi olan kirac\u0131, Kurul\u2019a, ev sahibinden aidat\u0131n\u0131n baz\u0131 aylarda eksik, baz\u0131 aylarda ise hi\u00e7 yat\u0131r\u0131lmad\u0131\u011f\u0131na dair SMS iletimi konusunda ki\u015fisel verilerin hukuka ayk\u0131r\u0131 olarak i\u015flendi\u011fi, ki\u015fisel verilerinin ev sahibi ile payla\u015f\u0131lmas\u0131nda hi\u00e7bir bilgisi ve r\u0131zas\u0131n\u0131n bulunmad\u0131\u011f\u0131, bu do\u011frultuda veri sorumlusu site y\u00f6netimine ba\u015fvurmak suretiyle i\u015flenen\/aktar\u0131lan ki\u015fisel verileri ile ilgili bilgi talep etti\u011fi, site y\u00f6netiminin ise kirac\u0131n\u0131n aidat \u00f6deme bilgilerinin ev sahibinin talebi do\u011frultusunda payla\u015f\u0131ld\u0131\u011f\u0131n\u0131n belirtildi\u011fi, fakat <\/span><span class=\"large\">kirac\u0131ya ayd\u0131nlatma yap\u0131ld\u0131\u011f\u0131na veya kendisinden bu hususta a\u00e7\u0131k r\u0131za al\u0131nd\u0131\u011f\u0131na dair bir belge yahut herhangi bir hukuka uygunluk sebebinin de sunulamad\u0131\u011f\u0131 belirtilerek, site y\u00f6netimi hakk\u0131nda idari para cezas\u0131 uygulanmas\u0131 talep edilmi\u015ftir.<\/span><br><span class=\"large\"><\/span><br><span class=\"large\"> <strong>DE\u011eERLEND\u0130RME VE KARAR <\/strong><\/span><br><span class=\"large\"><\/span><br><span class=\"large\"> Olay incelenirken Kurul taraf\u0131ndan yap\u0131lan de\u011ferlendirmede: <\/span><br><span class=\"large\"><\/span><br><span class=\"large\"> * Kanunun \u2018Ki\u015fisel verilerin i\u015flenme \u015fartlar\u0131\u2019 ba\u015fl\u0131kl\u0131 5. maddesi uyar\u0131nca ki\u015fisel verilerin i\u015flenme \u015fartlar\u0131n\u0131n belirlendi\u011fi,<\/span><br><span class=\"large\"><\/span><br><span class=\"large\"> * 634 say\u0131l\u0131 Kat M\u00fclkiyeti Kanunu\u2019nun \u2018Ortak giderlerin teminat\u0131\u2019 ba\u015fl\u0131kl\u0131 22. maddesinin, \u201cKat malikinin, 20. madde uyar\u0131nca pay\u0131na d\u00fc\u015fecek gider ve avans borcundan ve gecikme tazminat\u0131ndan, ba\u011f\u0131ms\u0131z b\u00f6l\u00fcmlerin birinde kira akdine, oturma (s\u00fckna) hakk\u0131na veya ba\u015fka bir sebebe dayanarak devaml\u0131 bir \u015fekilde faydalananlar da m\u00fc\u015ftereken ve m\u00fcteselsilen sorumludur. Ancak, kirac\u0131n\u0131n sorumlulu\u011fu \u00f6demekle y\u00fck\u00fcml\u00fc oldu\u011fu kira miktar\u0131 ile s\u0131n\u0131rl\u0131 olup, yapt\u0131\u011f\u0131 \u00f6deme kira borcundan d\u00fc\u015f\u00fcl\u00fcr\u2026\u201d \u015feklinde oldu\u011fu,<\/span><br><span class=\"large\"><\/span><br><span class=\"large\"> * S\u00f6z konusu h\u00fck\u00fcm uyar\u0131nca ev sahibi ile kirac\u0131n\u0131n ortak giderler ve gecikme tazminat\u0131ndan m\u00fc\u015ftereken ve m\u00fcteselsilen sorumlu oldu\u011fu dikkate al\u0131nd\u0131\u011f\u0131nda, ev sahibinin, kirac\u0131s\u0131n\u0131n oturdu\u011fu dairenin aidat gibi apartman\u0131n ortak giderlerinden pay\u0131na d\u00fc\u015fen k\u0131s\u0131mlar\u0131n\u0131 \u00f6deyip \u00f6demedi\u011finden haberdar olmas\u0131nda, gerek ev sahibi gerek site y\u00f6netiminin menfaatinin bulundu\u011fu, dolay\u0131s\u0131yla s\u00f6z konusu veri i\u015fleme faaliyetinin; 6698 say\u0131l\u0131 Kanun\u2019un 5. maddesinin (2) numaral\u0131 f\u0131kras\u0131n\u0131n (e) bendi kapsam\u0131nda bir hakk\u0131n tesisi, kullan\u0131lmas\u0131 veya korunmas\u0131 \u00e7er\u00e7evesinde ger\u00e7ekle\u015ftirildi\u011fi,<\/span><br><span class=\"large\"><\/span><br><span class=\"large\"> * Bu itibarla site y\u00f6netiminin kirac\u0131ya verdi\u011fi cevapta da ev sahibinin iste\u011fi \u00fczerine kirac\u0131n\u0131n bor\u00e7 bilgilerinin ev sahibi ile payla\u015f\u0131ld\u0131\u011f\u0131n\u0131n ifade edildi\u011fi dikkate al\u0131nd\u0131\u011f\u0131nda, kirac\u0131ya site y\u00f6netimi taraf\u0131ndan verilen yan\u0131t\u0131n, kirac\u0131n\u0131n iddialar\u0131na konu hususlar\u0131 yeterli derecede a\u00e7\u0131klay\u0131c\u0131 oldu\u011fu tespit edilerek, site y\u00f6netimi hakk\u0131nda yap\u0131lacak bir i\u015flem bulunmad\u0131\u011f\u0131na karar verilmi\u015ftir.<\/span><br><span class=\"large\"><\/span><br><span class=\"large\"> <strong>KARARA \u0130L\u0130\u015eK\u0130N P\u00dcF NOKTALARI <\/strong><\/span><br><span class=\"large\"><\/span><br><span class=\"large\"> 1. Ev sahibi ile kirac\u0131n\u0131n ortak giderlerden m\u00fc\u015ftereken ve m\u00fcteselsilen sorumlu olmas\u0131 sebebiyle kirac\u0131n\u0131n ortak giderleri \u00f6demedi\u011fi hususunun ev sahibine bildirilmesinde hem ev sahibinin hem de site y\u00f6netiminin menfaati bulunur.<\/span><br><span class=\"large\"><\/span><br><span class=\"large\"> 3.
