Yarg\u0131tay Hukuk Genel Kurulu taraf\u0131ndan verilen 2017\/7-3017 E. 2018\/99 K. say\u0131l\u0131 24.1.2018 tarihli kararda, psikolojik \u015fiddet davran\u0131\u015f\u0131n\u0131n s\u00fcrekli ve sistematik olmas\u0131 gereklili\u011fi bir kez daha vurgulanarak her davran\u0131\u015f\u0131n bu kapsamda de\u011ferlendirilemeyece\u011fine dair h\u00fck\u00fcm kurulmu\u015ftur.<\/span><\/p>  <p><span class=\"large\">\u201cDavac\u0131 vekili, daval\u0131 i\u015fyerinde amirlerinin s\u00f6zl\u00fc sald\u0131r\u0131 ve hakaretlerine maruz kald\u0131\u011f\u0131n\u0131, ki\u015filik haklar\u0131n\u0131n \u00e7i\u011fnendi\u011fini, istirahatli oldu\u011fu zamanda banka \u015fube m\u00fcd\u00fcr\u00fc taraf\u0131ndan oluru al\u0131nmaks\u0131z\u0131n \u00e7al\u0131\u015fma masas\u0131, \u00e7ekmeceleri, \u00f6zel e\u015fyalar\u0131n\u0131n arand\u0131\u011f\u0131n\u0131 ve b\u00f6ylece di\u011fer \u00e7al\u0131\u015fma arkada\u015flar\u0131 kar\u015f\u0131s\u0131nda k\u00fc\u00e7\u00fck d\u00fc\u015f\u00fcr\u00fcld\u00fc\u011f\u00fcn\u00fc, kendisine \u00fcstleri taraf\u0131ndan sistematik bir bi\u00e7imde i\u015ften istifa etmesi i\u00e7in her t\u00fcrl\u00fc k\u00f6t\u00fc muamele, tehdit, a\u015fa\u011f\u0131lama gibi davran\u0131\u015flar uyguland\u0131\u011f\u0131n\u0131, bunun neticesinde ortaya \u00e7\u0131kanpsikolojiktacizin E.\u00dc. T\u0131p Fak\u00fcltesi Ruh Sa\u011fl\u0131\u011f\u0131 ve Hastal\u0131klar\u0131 Anabilim Dal\u0131 Ba\u015fkanl\u0131\u011f\u0131n\u0131n raporu ile sabit hale geldi\u011fini, mobbing eylemlerine ra\u011fmen daval\u0131 i\u015fverenin i\u015f\u00e7isine kar\u015f\u0131 koruma sorumlulu\u011funu yerine getirmedi\u011fini, davac\u0131n\u0131n i\u015f yerinde y\u0131prat\u0131lmas\u0131n\u0131 \u00f6nleyemedi\u011fini, davac\u0131n\u0131n i\u015fini, g\u00f6revini gere\u011fi gibi yapmas\u0131na, yapmak i\u00e7in u\u011fra\u015f vermesine ra\u011fmen onurunun, ki\u015fili\u011finin, i\u015f ortam\u0131nda incitilmesine, k\u00fc\u00e7\u00fck d\u00fc\u015f\u00fcr\u00fclmesine, \u00fcz\u00fcnt\u00fc ve s\u0131k\u0131nt\u0131 i\u00e7inde kalmas\u0131na neden olundu\u011funu belirterek manevi tazminat alaca\u011f\u0131n\u0131n tahsilini istemi\u015ftir.<\/span><\/p>  <p><span class=\"large\">Dosyaya ibraz edilen bilgi ve belgeler ile di\u011fer t\u00fcm deliller birlikte de\u011ferlendirildi\u011finde; i\u015fyerinde uygulanmakta olan Personel Y\u00f6netmeli\u011fi uyar\u0131nca \u00e7ekmecelerinin aranmamas\u0131 noktas\u0131nda davac\u0131 i\u015f\u00e7inin hakl\u0131 bir beklentisinin s\u00f6z konusu olmayaca\u011f\u0131, ancak d\u00fc\u015f\u00fck performansla \u00e7al\u0131\u015ft\u0131\u011f\u0131n\u0131n ispatlanamamas\u0131, e-mail i\u00e7erikleri, davan\u0131n a\u00e7\u0131ld\u0131\u011f\u0131 tarihten yakla\u015f\u0131k iki y\u0131l sonra E.\u00dc. T\u0131p Fak\u00fcltesi \u00f6\u011fretim \u00fcyelerince tanzim edilen heyet raporu i\u00e7eri\u011fi, davac\u0131n\u0131n y\u00f6netmen olmas\u0131na ra\u011fmen kendisine bu y\u00f6nde bir muamele yap\u0131lmay\u0131p, ba\u011f\u0131r\u0131l\u0131p azarland\u0131\u011f\u0131 y\u00f6n\u00fcndeki tan\u0131k anlat\u0131mlar\u0131 ve t\u00fcm dosya i\u00e7eri\u011fi dikkate al\u0131nd\u0131\u011f\u0131nda, davac\u0131 i\u015f\u00e7inin hedef al\u0131narak uzun bir s\u00fcreye yay\u0131lan ve sistematik h\u00e2l alanpsikolojiktaciz niteli\u011findeki davran\u0131\u015flara maruz kald\u0131\u011f\u0131 sonucuna var\u0131lm\u0131\u015ft\u0131r.
