Madde eklendi. <\/span><\/p>  <p><span class=\"large\"><strong>KAYIT DI\u015eI \u00c7ALI\u015eMA <\/strong><\/span><\/p>  <p><span class=\"large\">\u00d6zetle \u2018\u0130stihdama D\u00f6n\u00fc\u015f Te\u015fviki\u2019 \u015feklinde adland\u0131rabilece\u011fimiz bu yeni d\u00fczenleme ile; her t\u00fcrl\u00fc i\u015f veya hizmet s\u00f6zle\u015fmesiyle hizmetleri SGK\u2019ya bildirilerek veya bildirilmeksizin (kay\u0131t d\u0131\u015f\u0131-sigortas\u0131z) 5510\/4-1 (a) bendi kapsam\u0131nda istihdam edilip de i\u015f akdinin 1 Ocak 2019-17 Nisan 2020 tarihleri aras\u0131nda ve 4857\/25-II maddesinde belirtilen ahlak ve iyi niyet kurallar\u0131na uymayan haller ve benzeri sebepler d\u0131\u015f\u0131nda sona eren \u00e7al\u0131\u015fanlar\u0131n son i\u015fyerlerine yasa ve genelgede belirtilen ko\u015fullar ile ba\u015fvurmalar\u0131n\u0131n \u00f6n\u00fc a\u00e7\u0131ld\u0131 ve tekrar istihdam halinde i\u015fverene ve istihdam talebinin kabul edilmemesi halinde ise i\u015f\u00e7iye y\u00f6nelik te\u015fvik d\u00fczenlemeleri yap\u0131ld\u0131. Yasada 1 Aral\u0131k 2020 tarihi itibar\u0131yla kay\u0131t d\u0131\u015f\u0131 olarak istihdam edilmeye devam edilen sigortal\u0131lar\u0131n da destekten yararlanabilece\u011fi d\u00fczenlendi\u011finden \u00f6zellikle kay\u0131t d\u0131\u015f\u0131 \u00e7al\u0131\u015fmalar\u0131n s\u00f6z konusu te\u015fvikler ile azalt\u0131lmas\u0131 ama\u00e7land\u0131. <\/span><\/p>  <p><span class=\"large\">Yasada dikkat \u00e7ekici olarak SGK\u2019ya bildirilmeksizin \u00e7al\u0131\u015ft\u0131r\u0131lan personel i\u00e7in \u00f6ng\u00f6r\u00fclen \u015fartlarla istihdam sa\u011flanmas\u0131 halinde i\u015fverenlere ge\u00e7mi\u015fe d\u00f6n\u00fck idari para cezas\u0131n\u0131n uygulanmayaca\u011f\u0131 ve bu i\u015fverenlerin ilgili d\u00f6nemlerde faydaland\u0131klar\u0131 te\u015fvik, destek ve indirimlerin de iptal edilmeyece\u011fi d\u00fczenlemesi yer al\u0131yor. <\/span><\/p>  <p><span class=\"large\"><strong>E-SGK \u00dcZER\u0130NDEN BA\u015eVURU<\/strong><\/span><\/p>  <p><span class=\"large\">Sosyal G\u00fcvenlik Kurumu taraf\u0131ndan haz\u0131rlanan 26 Kas\u0131m 2020 tarihli ve 2020\/50 Say\u0131l\u0131 Genelge\u2019ye g\u00f6re; ilgili ko\u015fullar\u0131 sa\u011flayan i\u015f\u00e7i ve i\u015fverenlerin 4447 Say\u0131l\u0131 \u0130\u015fsizlik Sigortas\u0131 Kanunu\u2019na eklenen Ge\u00e7ici 27. Madde kapsam\u0131nda \u0130stihdama D\u00f6n\u00fc\u015f Te\u015fviki\u2019nden yararlanabilece\u011fi d\u00fczenlendi.<\/span><\/p>  <p><span class=\"large\">Yasa, istihdama d\u00f6n\u00fc\u015f i\u00e7in i\u015fverenin d\u00f6n\u00fc\u015f ba\u015fvurusunu kabul i\u00e7in bir zorunluluk getirmeyip, kendisine ba\u015fvuru yap\u0131lan bir i\u015fverene (i) Fiilen \u00e7al\u0131\u015ft\u0131rma, (ii) \u0130\u015fe ba\u015flat\u0131p \u00fccretsiz izne ay\u0131rma veya (iii) Ba\u015fvurunun kabul edilmemesi yetkilerini tan\u0131d\u0131.<\/span><\/p>  <p><span class=\"large\">Genelgenin 1.maddesinin c f\u0131kras\u0131nda a\u00e7\u0131k olarak ba\u015fvurunun kabul edilmemesi hali bir se\u00e7enek olarak d\u00fczenlenmi\u015f oldu\u011fundan i\u015fverenin kendisine gelen istihdama d\u00f6n\u00fc\u015f ba\u015fvurusunu kabul zorunlulu\u011fu bulunmuyor.<\/span><\/p>  <p><span class=\"large\">\u0130\u015fverenlerin prim te\u015fvikinden yararlanabilmeleri i\u00e7in e-SGK \u00fczerinden ba\u015fvuruda bulunmas\u0131 istenilmi\u015f olup, ayr\u0131ca fiziken Sosyal G\u00fcvenlik Kurumu\u2019na ba\u015fvuru yap\u0131lmayaca\u011f\u0131 a\u00e7\u0131kland\u0131.<\/span><\/p>  <p><span class=\"large\">Yine ilgili destekten belirtilen \u015fartlar\u0131 sa\u011flayan sigortal\u0131lar i\u00e7in 1 Aral\u0131k 2020\u2019den itibaren 4857 say\u0131l\u0131 Kanun\u2019un ge\u00e7ici 10. maddesinde yer alan fesih yap\u0131lamayacak s\u00fcreyi ge\u00e7memek \u00fczere her ay yararlan\u0131labilecek.<\/span><\/p>  <p><span class=\"large\">S\u00f6z konusu d\u00fczenleme ile \u00f6zellikle mevcuttaki ilave istihdam te\u015fvikleri ile sa\u011flanmas\u0131 ama\u00e7lanan istihdam\u0131n korunmas\u0131na ilaveten \u00f6zellikle i\u015f s\u00f6zle\u015fmeleri pandemi d\u00f6nemi \u00f6ncesi 1 Ocak 2019-17 Nisan 2020 tarihleri aras\u0131nda sona ermi\u015f sigortal\u0131lar i\u00e7in istihdama geri d\u00f6n\u00fc\u015f ve istihdam\u0131n art\u0131r\u0131lmas\u0131 ama\u00e7land\u0131.
