Do\u011fum izni ya da di\u011fer izinlerini kullanmas\u0131n\u0131n ard\u0131ndan i\u015fe d&ouml;n&uuml;\u015f&uuml;nde i\u015f s&ouml;zle\u015fmesinde tarif edilen g&ouml;rev tan\u0131m\u0131 d\u0131\u015f\u0131nda uzmanl\u0131k gerektiren ba\u015fka bir pozisyonda &ccedil;al\u0131\u015fmaya zorlanmas\u0131, i\u015f&ccedil;i i&ccedil;in hakl\u0131 sebeple fesih ve ayr\u0131mc\u0131l\u0131k tazminat\u0131 nedeni olabilir mi?&nbsp;<\/p><p><br><\/p><p><span style=\"background-color: transparent; letter-spacing: 0.01rem;\">\u0130\u015f Kanunu&rsquo;nda kad\u0131n i\u015f&ccedil;ilerin do\u011fumdan &ouml;nce sekiz, do\u011fumdan sonra sekiz hafta olmak &uuml;zere toplam 16 haftal\u0131k s&uuml;re i&ccedil;in &ccedil;al\u0131\u015ft\u0131r\u0131lmamalar\u0131n\u0131n esas oldu\u011fu h&uuml;k&uuml;m alt\u0131na al\u0131nm\u0131\u015ft\u0131r. Kanunda ayr\u0131ca iste\u011fi h&acirc;linde kad\u0131n i\u015f&ccedil;iye, 16 haftal\u0131k s&uuml;renin tamamlanmas\u0131ndan veya &ccedil;o\u011ful gebelik h&acirc;linde 18 haftal\u0131k s&uuml;reden sonra alt\u0131 aya kadar &uuml;cretsiz izin verilece\u011fi d&uuml;zenlenmi\u015ftir. Bu d&uuml;zenlemeye istinaden do\u011fum izni sonras\u0131nda i\u015fe ba\u015flayan i\u015f&ccedil;inin uzmanl\u0131k alan\u0131 d\u0131\u015f\u0131nda ba\u015fka bir pozisyonda &ccedil;al\u0131\u015ft\u0131r\u0131lmaya zorlanmas\u0131na binaen ortaya &ccedil;\u0131kan uyu\u015fmazl\u0131kla ilgili Yarg\u0131tay&rsquo;\u0131n emsal nitelikteki karar\u0131, bu yaz\u0131m\u0131zda de\u011ferlendirildi.<\/span><\/p><p><br><\/p><p><strong style=\"background-color: transparent; letter-spacing: 0.01rem;\">KARAR B\u0130LG\u0130LER\u0130<\/strong><\/p><p><strong>Karar\u0131 veren daire ba\u015fkanl\u0131\u011f\u0131<\/strong>: Yarg\u0131tay 9. Hukuk Dairesi&nbsp;<\/p><p><strong>Karar bilgileri:<\/strong> 2023\/3413 Esas., 2024\/7893 K.<\/p><p><strong>Yasal dayana\u011f\u0131:<\/strong> 4857 say\u0131l\u0131 \u0130\u015f Kanunu ile bu kanuna istinaden y&uuml;r&uuml;rl&uuml;kte bulunan alt mevzuatta yer alan h&uuml;k&uuml;mler uygulaman\u0131n yasal dayana\u011f\u0131n\u0131 te\u015fkil ediyor.<\/p><p><br><\/p><p><strong style=\"background-color: transparent; letter-spacing: 0.01rem;\">KARARIN KONUSU<\/strong><\/p><p>Davan\u0131n konusu &ouml;zetle; davac\u0131 i\u015f&ccedil;inin do\u011fum iznine ayr\u0131ld\u0131\u011f\u0131, do\u011fum izni sonras\u0131 eski i\u015fi yerine kendisine ba\u015fka bir i\u015f teklif edildi\u011fi, uzmanl\u0131k alan\u0131 d\u0131\u015f\u0131nda oldu\u011fu i&ccedil;in bu pozisyonda &ccedil;al\u0131\u015fmay\u0131 kabul etmedi\u011fi ve i\u015f s&ouml;zle\u015fmesini hakl\u0131 nedenle feshetti\u011fi, bu kapsamda manevi tazminat, k\u0131dem tazminat\u0131, maddi zarar (tedavi masraflar\u0131), ayr\u0131mc\u0131l\u0131k tazminat\u0131 ile di\u011fer alacaklar\u0131n\u0131n daval\u0131dan tahsiline karar verilmesine ili\u015fkindir.<\/p><p><br><\/p><p><strong style=\"background-color: transparent; letter-spacing: 0.01rem;\">MAHKEME KARARLARI<\/strong><\/p><p>Yerel mahkeme; davac\u0131 i\u015f&ccedil;inin i\u015f s&ouml;zle\u015fmesini hakl\u0131 nedenle sona erdirdi\u011fini kabul ederek, i\u015f&ccedil;ilik alacak ve tazminatlar\u0131na h&uuml;kmetmesine kar\u015f\u0131n planl\u0131 ve sistematik bir bezdirmeye maruz kald\u0131\u011f\u0131n\u0131 ispat edemedi\u011finden ayr\u0131mc\u0131l\u0131k tazminat\u0131 ile manevi tazminat taleplerini reddederek davan\u0131n k\u0131smen kabul&uuml;ne karar verdi. Bunun &uuml;zerine davac\u0131, manevi tazminatla ayr\u0131mc\u0131l\u0131k tazminat\u0131 taleplerinin reddine karar verilmesinin hatal\u0131 oldu\u011funu ileri s&uuml;rerek, istinafa ba\u015fvurdu.<\/p><p><br><\/p><p><span style=\"background-color: transparent; letter-spacing: 0.01rem;\">B&ouml;lge Adliye Mahkemesi; i\u015f s&ouml;zle\u015fmesinin feshinin hakl\u0131 oldu\u011fu ve davac\u0131-kar\u015f\u0131 daval\u0131 i\u015f&ccedil;inin k\u0131dem tazminat\u0131na hak kazand\u0131\u011f\u0131, i\u015f s&ouml;zle\u015fmesinin davac\u0131-kar\u015f\u0131 daval\u0131 taraf\u0131ndan hakl\u0131 nedenle feshedilmesi nedeniyle ihbar tazminat\u0131 talebinin reddinin isabetli oldu\u011fu, ilk derece mahkemesince prim, fazla &ccedil;al\u0131\u015fma &uuml;creti ile y\u0131ll\u0131k izin &uuml;cretinin h&uuml;k&uuml;m alt\u0131na al\u0131nmas\u0131n\u0131n yerinde oldu\u011fu, s&ouml;z konusu alacaklar\u0131n hesaplanma y&ouml;nteminde hata bulunmad\u0131\u011f\u0131, davac\u0131-kar\u015f\u0131 daval\u0131 i\u015f&ccedil;i taraf\u0131ndan psikolojik taciz ve ayr\u0131mc\u0131l\u0131\u011fa maruz kald\u0131\u011f\u0131na ili\u015fkin iddialar\u0131n ispatlanamamas\u0131na g&ouml;re ilk derece mahkemesince taleplerin reddine karar verilmesinin yerinde oldu\u011fu gerek&ccedil;esiyle taraf vekillerinin istinaf ba\u015fvurular\u0131n\u0131n ayr\u0131 ayr\u0131 esastan reddine karar verdi.<\/span><\/p><p><br><\/p><p><strong style=\"background-color: transparent; letter-spacing: 0.01rem;\">YARGITAY KARARI &Ouml;ZET\u0130<\/strong><\/p><p>B&ouml;lge Adliye Mahkemesi karar\u0131n\u0131n temyiz edilmesi &uuml;zerine inceleme konusu Yarg\u0131tay karar\u0131nda &ouml;zetle \u015fu hususlara yer verildi: &ldquo;Somut uyu\u015fmazl\u0131kta davac\u0131-kar\u015f\u0131 daval\u0131 i\u015f&ccedil;inin; i\u015fyerinde yat\u0131r\u0131m\/ara\u015ft\u0131rma\/hisse senedi ara\u015ft\u0131rma\/k\u0131demli analist olarak &ccedil;al\u0131\u015ft\u0131\u011f\u0131, do\u011fum izni sonras\u0131 i\u015fe ba\u015flad\u0131\u011f\u0131nda kendisine sigorta sekt&ouml;r&uuml;n&uuml; takip i\u015fi verildi\u011fi, bu pozisyonda &ccedil;al\u0131\u015fmay\u0131 kabul etmedi\u011fi ve i\u015f s&ouml;zle\u015fmesini hakl\u0131 nedenle feshetti\u011fi sabittir. Mahkemelerce davac\u0131n\u0131n ayr\u0131mc\u0131l\u0131k iddias\u0131n\u0131 ispat edemedi\u011fi gerek&ccedil;esiyle ayr\u0131mc\u0131l\u0131k tazminat\u0131 talebinin reddine karar verilmi\u015f ise de ret karar\u0131 dosya kapsam\u0131na uygun d&uuml;\u015fmemektedir.<\/p><p><br><\/p><p>&nbsp;Dosya kapsam\u0131ndaki deliller, dinlenen tan\u0131klar\u0131n anlat\u0131m\u0131 dikkate al\u0131nd\u0131\u011f\u0131nda davac\u0131 i\u015f&ccedil;inin do\u011fum iznine ayr\u0131ld\u0131\u011f\u0131, do\u011fum izni sonras\u0131 davac\u0131ya eski i\u015fi yerine ba\u015fka bir i\u015f teklif edildi\u011fi, bu i\u015fin davac\u0131n\u0131n uzmanl\u0131k alan\u0131n\u0131n d\u0131\u015f\u0131nda oldu\u011fu davac\u0131 taraf\u0131ndan ispat edilmi\u015ftir. Davac\u0131, 4857 say\u0131l\u0131 Kanun&rsquo;un 5. maddesinin son f\u0131kras\u0131 uyar\u0131nca bir ihlalin varl\u0131\u011f\u0131 ihtimalini g&uuml;&ccedil;l&uuml; bi&ccedil;imde g&ouml;steren bir durumu ortaya koymu\u015ftur. Bu durumda, b&ouml;yle bir ihlalin mevcut olmad\u0131\u011f\u0131n\u0131 ispat y&uuml;k&uuml; &uuml;zerinde olan i\u015fverenin davac\u0131n\u0131n do\u011fum &ouml;ncesindeki konumunun ve g&ouml;revinin do\u011fum sonras\u0131nda hangi sebeplerle de\u011fi\u015ftirildi\u011fini, davac\u0131ya farkl\u0131 muamele yap\u0131lmas\u0131n\u0131 gerektiren nedenleri somut olgularla ortaya koyamad\u0131\u011f\u0131 anla\u015f\u0131lmaktad\u0131r. H&acirc;l b&ouml;yle olunca ilk derece mahkemesince ayr\u0131mc\u0131l\u0131k tazminat\u0131 talebinin kabul&uuml; gerekirken yaz\u0131l\u0131 gerek&ccedil;eyle reddi hatal\u0131 olup bozmay\u0131 gerektirmi\u015ftir.&rdquo;&nbsp;<\/p><p><br><\/p><p><strong>\u0130\u015eVEREN AYRIMCILIK TAZM\u0130NATINA MAHKUM OLUR<\/strong><\/p><p>Do\u011fum iznine ayr\u0131lan i\u015f&ccedil;inin, do\u011fum izni sonras\u0131nda g&ouml;reve ba\u015flarken do\u011fum &ouml;ncesinde &ccedil;al\u0131\u015ft\u0131\u011f\u0131 uzmanl\u0131k alan\u0131 d\u0131\u015f\u0131nda ba\u015fka bir i\u015f kapsam\u0131nda &ccedil;al\u0131\u015ft\u0131r\u0131lmaya zorlanmas\u0131n\u0131n i\u015f&ccedil;i i&ccedil;in hakl\u0131 sebep te\u015fkil edece\u011fi izahtan varestedir. Hakl\u0131 sebeple fesihte elbette ki i\u015f&ccedil;i \u015fartlar\u0131 varsa k\u0131dem tazminat\u0131 ve di\u011fer i\u015f&ccedil;ilik alacaklar\u0131na hak kazanacakt\u0131r.&nbsp;<\/p><p><br><\/p><p><span style=\"background-color: transparent; letter-spacing: 0.01rem;\">Hakl\u0131 feshe ba\u011fl\u0131 i\u015f&ccedil;ilik tazminat ve alacaklar\u0131n\u0131n yan\u0131 s\u0131ra i\u015fverenin sebepsiz ve keyfi muamelerle 4857 say\u0131l\u0131 \u0130\u015f Kanunu&rsquo;nun 5. maddesinde h&uuml;kme ba\u011flanan &lsquo;e\u015fit davranma ilkesini&rsquo; de ihlal etti\u011finin tespit edilmesi halinde ayr\u0131mc\u0131l\u0131k tazminat\u0131na da mahkum olabilece\u011fi unutulmamal\u0131.&nbsp;<\/span><\/p><p><br><\/p><p><span style=\"background-color: transparent; letter-spacing: 0.01rem;\">E\u015fit davranma ilkesi t&uuml;m hukuk alan\u0131nda ge&ccedil;erli olup, i\u015f hukuku bak\u0131m\u0131ndan i\u015fverene i\u015fyerinde &ccedil;al\u0131\u015fan i\u015f&ccedil;iler aras\u0131nda hakl\u0131 ve objektif bir neden olmad\u0131k&ccedil;a farkl\u0131 davranmama borcu y&uuml;kl&uuml;yor. Bu bak\u0131mdan i\u015fverenin y&ouml;netim hakk\u0131 s\u0131n\u0131rland\u0131r\u0131lm\u0131\u015f durumdad\u0131r.&nbsp;<\/span><\/p><p><br><\/p><p><span style=\"background-color: transparent; letter-spacing: 0.01rem;\">\u0130nceleme konusu kararda do\u011fum izninden do\u011fan kad\u0131n i\u015f&ccedil;iye yapt\u0131\u011f\u0131 i\u015fin d\u0131\u015f\u0131nda ba\u015fka bir uzmanl\u0131k gerektiren i\u015f verilirken i\u015finin de\u011fi\u015ftirilmesini gerektiren objektif ve hakl\u0131 bir gerek&ccedil;e ileri s&uuml;r&uuml;lememi\u015ftir. Bu minvalde do\u011fum iznini kullanan kad\u0131n i\u015f&ccedil;i y&ouml;n&uuml;nden i\u015fverenin e\u015fit davranma borcuna vurgu yapan \u0130stihdam ve Meslek Konular\u0131nda Kad\u0131n ve Erke\u011fe E\u015fit Muamele ve F\u0131rsat E\u015fitli\u011fi \u0130lkesinin Uygulanmas\u0131na Dair 5.7.2006 tarihli Avrupa Parlamentosu ve Konseyinin 2006\/54\/EC Say\u0131l\u0131 Direktifinin &lsquo;Anal\u0131k (Do\u011fum) \u0130zninden D&ouml;n&uuml;\u015f&rsquo; ba\u015fl\u0131kl\u0131 15. maddesinde, &ldquo;Do\u011fum iznindeki bir kad\u0131n\u0131n, do\u011fum izninin bitiminden sonra i\u015fine veya e\u015fde\u011fer bir pozisyona kendisi i&ccedil;in daha dezavantajl\u0131 olmayan ko\u015ful ve \u015fartlarda geri d&ouml;nmeye ve &ccedil;al\u0131\u015fma ko\u015fullar\u0131nda yoklu\u011fu s\u0131ras\u0131nda yararlanm\u0131\u015f olaca\u011f\u0131 her t&uuml;rl&uuml; iyile\u015ftirmeden yararlanmaya hakk\u0131 vard\u0131r&rdquo; \u015feklinde kurala da ayk\u0131r\u0131 oldu\u011fu a\u015fikard\u0131r. Bu d&uuml;zenlemeye istinaden do\u011fum izni sonras\u0131nda i\u015fe ba\u015flayan i\u015f&ccedil;inin uzmanl\u0131k alan\u0131 d\u0131\u015f\u0131nda ba\u015fka bir pozisyonda &ccedil;al\u0131\u015ft\u0131r\u0131lmaya zorlanmas\u0131na binaen ortaya &ccedil;\u0131kan uyu\u015fmazl\u0131kla ilgili Yarg\u0131tay&rsquo;\u0131n emsal nitelikteki karar\u0131, bu yaz\u0131m\u0131zda de\u011ferlendirildi.<\/span><\/p><p><br><\/p><p><strong style=\"background-color: transparent; letter-spacing: 0.01rem;\">KARAR B\u0130LG\u0130LER\u0130<\/strong><\/p><p><strong>Karar\u0131 veren daire ba\u015fkanl\u0131\u011f\u0131<\/strong>: Yarg\u0131tay 9. Hukuk Dairesi&nbsp;<\/p><p><strong>Karar bilgileri:<\/strong> 2023\/3413 Esas., 2024\/7893 K.<\/p><p><strong>Yasal dayana\u011f\u0131:<\/strong> 4857 say\u0131l\u0131 \u0130\u015f Kanunu ile bu kanuna istinaden y&uuml;r&uuml;rl&uuml;kte bulunan alt mevzuatta yer alan h&uuml;k&uuml;mler uygulaman\u0131n yasal dayana\u011f\u0131n\u0131 te\u015fkil ediyor.<\/p><p><br><\/p><p><strong style=\"background-color: transparent; letter-spacing: 0.01rem;\">KARARIN KONUSU<\/strong><\/p><p>Davan\u0131n konusu &ouml;zetle; davac\u0131 i\u015f&ccedil;inin do\u011fum iznine ayr\u0131ld\u0131\u011f\u0131, do\u011fum izni sonras\u0131 eski i\u015fi yerine kendisine ba\u015fka bir i\u015f teklif edildi\u011fi, uzmanl\u0131k alan\u0131 d\u0131\u015f\u0131nda oldu\u011fu i&ccedil;in bu pozisyonda &ccedil;al\u0131\u015fmay\u0131 kabul etmedi\u011fi ve i\u015f s&ouml;zle\u015fmesini hakl\u0131 nedenle feshetti\u011fi, bu kapsamda manevi tazminat, k\u0131dem tazminat\u0131, maddi zarar (tedavi masraflar\u0131), ayr\u0131mc\u0131l\u0131k tazminat\u0131 ile di\u011fer alacaklar\u0131n\u0131n daval\u0131dan tahsiline karar verilmesine ili\u015fkindir.<\/p><p><br><\/p><p><strong style=\"background-color: transparent; letter-spacing: 0.01rem;\">MAHKEME KARARLARI<\/strong><\/p><p>Yerel mahkeme; davac\u0131 i\u015f&ccedil;inin i\u015f s&ouml;zle\u015fmesini hakl\u0131 nedenle sona erdirdi\u011fini kabul ederek, i\u015f&ccedil;ilik alacak ve tazminatlar\u0131na h&uuml;kmetmesine kar\u015f\u0131n planl\u0131 ve sistematik bir bezdirmeye maruz kald\u0131\u011f\u0131n\u0131 ispat edemedi\u011finden ayr\u0131mc\u0131l\u0131k tazminat\u0131 ile manevi tazminat taleplerini reddederek davan\u0131n k\u0131smen kabul&uuml;ne karar verdi. Bunun &uuml;zerine davac\u0131, manevi tazminatla ayr\u0131mc\u0131l\u0131k tazminat\u0131 taleplerinin reddine karar verilmesinin hatal\u0131 oldu\u011funu ileri s&uuml;rerek, istinafa ba\u015fvurdu.<\/p><p><br><\/p><p><span style=\"background-color: transparent; letter-spacing: 0.01rem;\">B&ouml;lge Adliye Mahkemesi; i\u015f s&ouml;zle\u015fmesinin feshinin hakl\u0131 oldu\u011fu ve davac\u0131-kar\u015f\u0131 daval\u0131 i\u015f&ccedil;inin k\u0131dem tazminat\u0131na hak kazand\u0131\u011f\u0131, i\u015f s&ouml;zle\u015fmesinin davac\u0131-kar\u015f\u0131 daval\u0131 taraf\u0131ndan hakl\u0131 nedenle feshedilmesi nedeniyle ihbar tazminat\u0131 talebinin reddinin isabetli oldu\u011fu, ilk derece mahkemesince prim, fazla &ccedil;al\u0131\u015fma &uuml;creti ile y\u0131ll\u0131k izin &uuml;cretinin h&uuml;k&uuml;m alt\u0131na al\u0131nmas\u0131n\u0131n yerinde oldu\u011fu, s&ouml;z konusu alacaklar\u0131n hesaplanma y&ouml;nteminde hata bulunmad\u0131\u011f\u0131, davac\u0131-kar\u015f\u0131 daval\u0131 i\u015f&ccedil;i taraf\u0131ndan psikolojik taciz ve ayr\u0131mc\u0131l\u0131\u011fa maruz kald\u0131\u011f\u0131na ili\u015fkin iddialar\u0131n ispatlanamamas\u0131na g&ouml;re ilk derece mahkemesince taleplerin reddine karar verilmesinin yerinde oldu\u011fu gerek&ccedil;esiyle taraf vekillerinin istinaf ba\u015fvurular\u0131n\u0131n ayr\u0131 ayr\u0131 esastan reddine karar verdi.<\/span><\/p><p><br><\/p><p><strong style=\"background-color: transparent; letter-spacing: 0.01rem;\">YARGITAY KARARI &Ouml;ZET\u0130<\/strong><\/p><p>B&ouml;lge Adliye Mahkemesi karar\u0131n\u0131n temyiz edilmesi &uuml;zerine inceleme konusu Yarg\u0131tay karar\u0131nda &ouml;zetle \u015fu hususlara yer verildi: &ldquo;Somut uyu\u015fmazl\u0131kta davac\u0131-kar\u015f\u0131 daval\u0131 i\u015f&ccedil;inin; i\u015fyerinde yat\u0131r\u0131m\/ara\u015ft\u0131rma\/hisse senedi ara\u015ft\u0131rma\/k\u0131demli analist olarak &ccedil;al\u0131\u015ft\u0131\u011f\u0131, do\u011fum izni sonras\u0131 i\u015fe ba\u015flad\u0131\u011f\u0131nda kendisine sigorta sekt&ouml;r&uuml;n&uuml; takip i\u015fi verildi\u011fi, bu pozisyonda &ccedil;al\u0131\u015fmay\u0131 kabul etmedi\u011fi ve i\u015f s&ouml;zle\u015fmesini hakl\u0131 nedenle feshetti\u011fi sabittir. Mahkemelerce davac\u0131n\u0131n ayr\u0131mc\u0131l\u0131k iddias\u0131n\u0131 ispat edemedi\u011fi gerek&ccedil;esiyle ayr\u0131mc\u0131l\u0131k tazminat\u0131 talebinin reddine karar verilmi\u015f ise de ret karar\u0131 dosya kapsam\u0131na uygun d&uuml;\u015fmemektedir.<\/p><p><br><\/p><p>&nbsp;Dosya kapsam\u0131ndaki deliller, dinlenen tan\u0131klar\u0131n anlat\u0131m\u0131 dikkate al\u0131nd\u0131\u011f\u0131nda davac\u0131 i\u015f&ccedil;inin do\u011fum iznine ayr\u0131ld\u0131\u011f\u0131, do\u011fum izni sonras\u0131 davac\u0131ya eski i\u015fi yerine ba\u015fka bir i\u015f teklif edildi\u011fi, bu i\u015fin davac\u0131n\u0131n uzmanl\u0131k alan\u0131n\u0131n d\u0131\u015f\u0131nda oldu\u011fu davac\u0131 taraf\u0131ndan ispat edilmi\u015ftir. Davac\u0131, 4857 say\u0131l\u0131 Kanun&rsquo;un 5. maddesinin son f\u0131kras\u0131 uyar\u0131nca bir ihlalin varl\u0131\u011f\u0131 ihtimalini g&uuml;&ccedil;l&uuml; bi&ccedil;imde g&ouml;steren bir durumu ortaya koymu\u015ftur. Bu durumda, b&ouml;yle bir ihlalin mevcut olmad\u0131\u011f\u0131n\u0131 ispat y&uuml;k&uuml; &uuml;zerinde olan i\u015fverenin davac\u0131n\u0131n do\u011fum &ouml;ncesindeki konumunun ve g&ouml;revinin do\u011fum sonras\u0131nda hangi sebeplerle de\u011fi\u015ftirildi\u011fini, davac\u0131ya farkl\u0131 muamele yap\u0131lmas\u0131n\u0131 gerektiren nedenleri somut olgularla ortaya koyamad\u0131\u011f\u0131 anla\u015f\u0131lmaktad\u0131r. H&acirc;l b&ouml;yle olunca ilk derece mahkemesince ayr\u0131mc\u0131l\u0131k tazminat\u0131 talebinin kabul&uuml; gerekirken yaz\u0131l\u0131 gerek&ccedil;eyle reddi hatal\u0131 olup bozmay\u0131 gerektirmi\u015ftir.&rdquo;&nbsp;<\/p><p><br><\/p><p><strong>\u0130\u015eVEREN AYRIMCILIK TAZM\u0130NATINA MAHKUM OLUR<\/strong><\/p><p>Do\u011fum iznine ayr\u0131lan i\u015f&ccedil;inin, do\u011fum izni sonras\u0131nda g&ouml;reve ba\u015flarken do\u011fum &ouml;ncesinde &ccedil;al\u0131\u015ft\u0131\u011f\u0131 uzmanl\u0131k alan\u0131 d\u0131\u015f\u0131nda ba\u015fka bir i\u015f kapsam\u0131nda &ccedil;al\u0131\u015ft\u0131r\u0131lmaya zorlanmas\u0131n\u0131n i\u015f&ccedil;i i&ccedil;in hakl\u0131 sebep te\u015fkil edece\u011fi izahtan varestedir. Hakl\u0131 sebeple fesihte elbette ki i\u015f&ccedil;i \u015fartlar\u0131 varsa k\u0131dem tazminat\u0131 ve di\u011fer i\u015f&ccedil;ilik alacaklar\u0131na hak kazanacakt\u0131r.&nbsp;<\/p><p><br><\/p><p><span style=\"background-color: transparent; letter-spacing: 0.01rem;\">Hakl\u0131 feshe ba\u011fl\u0131 i\u015f&ccedil;ilik tazminat ve alacaklar\u0131n\u0131n yan\u0131 s\u0131ra i\u015fverenin sebepsiz ve keyfi muamelerle 4857 say\u0131l\u0131 \u0130\u015f Kanunu&rsquo;nun 5. maddesinde h&uuml;kme ba\u011flanan &lsquo;e\u015fit davranma ilkesini&rsquo; de ihlal etti\u011finin tespit edilmesi halinde ayr\u0131mc\u0131l\u0131k tazminat\u0131na da mahkum olabilece\u011fi unutulmamal\u0131.&nbsp;<\/span><\/p><p><br><\/p><p><span style=\"background-color: transparent; letter-spacing: 0.01rem;\">E\u015fit davranma ilkesi t&uuml;m hukuk alan\u0131nda ge&ccedil;erli olup, i\u015f hukuku bak\u0131m\u0131ndan i\u015fverene i\u015fyerinde &ccedil;al\u0131\u015fan i\u015f&ccedil;iler aras\u0131nda hakl\u0131 ve objektif bir neden olmad\u0131k&ccedil;a farkl\u0131 davranmama borcu y&uuml;kl&uuml;yor. Bu bak\u0131mdan i\u015fverenin y&ouml;netim hakk\u0131 s\u0131n\u0131rland\u0131r\u0131lm\u0131\u015f durumdad\u0131r.&nbsp;<\/span><\/p><p><br><\/p><p><span style=\"background-color: transparent; letter-spacing: 0.01rem;\">\u0130nceleme konusu kararda do\u011fum izninden do\u011fan kad\u0131n i\u015f&ccedil;iye yapt\u0131\u011f\u0131 i\u015fin d\u0131\u015f\u0131nda ba\u015fka bir uzmanl\u0131k gerektiren i\u015f verilirken i\u015finin de\u011fi\u015ftirilmesini gerektiren objektif ve hakl\u0131 bir gerek&ccedil;e ileri s&uuml;r&uuml;lememi\u015ftir. Bu minvalde do\u011fum iznini kullanan kad\u0131n i\u015f&ccedil;i y&ouml;n&uuml;nden i\u015fverenin e\u015fit davranma borcuna vurgu yapan \u0130stihdam ve Meslek Konular\u0131nda Kad\u0131n ve Erke\u011fe E\u015fit Muamele ve F\u0131rsat E\u015fitli\u011fi \u0130lkesinin Uygulanmas\u0131na Dair 5.7.2006 tarihli Avrupa Parlamentosu ve Konseyinin 2006\/54\/EC Say\u0131l\u0131 Direktifinin &lsquo;Anal\u0131k (Do\u011fum) \u0130zninden D&ouml;n&uuml;\u015f&rsquo; ba\u015fl\u0131kl\u0131 15. maddesinde, &ldquo;Do\u011fum iznindeki bir kad\u0131n\u0131n, do\u011fum izninin bitiminden sonra i\u015fine veya e\u015fde\u011fer bir pozisyona kendisi i&ccedil;in daha dezavantajl\u0131 olmayan ko\u015ful ve \u015fartlarda geri d&ouml;nmeye ve &ccedil;al\u0131\u015fma ko\u015fullar\u0131nda yoklu\u011fu s\u0131ras\u0131nda yararlanm\u0131\u015f olaca\u011f\u0131 her t&uuml;rl&uuml; iyile\u015ftirmeden yararlanmaya hakk\u0131 vard\u0131r&rdquo; \u015feklinde kurala da ayk\u0131r\u0131 oldu\u011fu a\u015fikard\u0131r.
