Daval\u0131 vekili, bu nedenle davac\u0131n\u0131n i\u015f akdinin \u0130\u015f Kanunu\u2019nun 25\/II-h, \u0131 maddeleri gere\u011fince feshedildi\u011fini savundu. Yarg\u0131tay karar\u0131nda \u00f6zetle; 4857 say\u0131l\u0131 yasa ile i\u015f\u00e7inin \u2018g\u00f6revi yapmamakta \u0131srar etmesi\u2019 kural\u0131 gere\u011fince i\u015fverenin hat\u0131rlatmas\u0131n\u0131n ard\u0131ndan sadece bir kez g\u00f6revi yapmaman\u0131n yeterli olmad\u0131\u011f\u0131, i\u015f\u00e7inin g\u00f6revi yapmama eyleminin hat\u0131rlatman\u0131n ard\u0131ndan da devaml\u0131l\u0131k arz etmesi gerekti\u011fi, hat\u0131rlatman\u0131n s\u00f6zl\u00fc ya da yaz\u0131l\u0131 bi\u00e7imde yap\u0131lmas\u0131n\u0131n m\u00fcmk\u00fcn oldu\u011fu, bu konuda ispat y\u00fck\u00fcn\u00fcn de i\u015fverene ait oldu\u011fu belirtildi. Halen uygulamada esas al\u0131nan 4857 say\u0131l\u0131 \u0130\u015f Kanunu\u2019nda ise i\u015f\u00e7inin \u2018g\u00f6revi yapmamakta \u0131srar etmesi\u2019 kural\u0131 getirildi. \u0130nceleme konusu kararda, isabetli olarak bu noktada i\u015fverenin hat\u0131rlatmas\u0131n\u0131n ard\u0131ndan sadece bir kez g\u00f6revi yapmaman\u0131n yeterli say\u0131lmayaca\u011f\u0131, i\u015f\u00e7inin g\u00f6revi yapmama eyleminin, hat\u0131rlatman\u0131n ard\u0131ndan devaml\u0131l\u0131k arz etmesi gerekti\u011fi \u00f6zellikle vurguland\u0131. Bu ba\u011flamda i\u015f\u00e7inin g\u00f6revini ifa etmemesine binaen i\u015f s\u00f6zle\u015fmesinin hakl\u0131 nedenle feshinin g\u00fcndeme gelmesi halinde \u015fu ilkelerin g\u00f6z \u00f6n\u00fcnde bulundurulmas\u0131 gerekiyor:<\/span><\/p><p Halen uygulamada esas al\u0131nan 4857 say\u0131l\u0131 \u0130\u015f Kanunu\u2019nda ise i\u015f\u00e7inin \u2018g\u00f6revi yapmamakta \u0131srar etmesi\u2019 kural\u0131 getirildi. \u0130nceleme konusu kararda, isabetli olarak bu noktada i\u015fverenin hat\u0131rlatmas\u0131n\u0131n ard\u0131ndan sadece bir kez g\u00f6revi yapmaman\u0131n yeterli say\u0131lmayaca\u011f\u0131, i\u015f\u00e7inin g\u00f6revi yapmama eyleminin, hat\u0131rlatman\u0131n ard\u0131ndan devaml\u0131l\u0131k arz etmesi gerekti\u011fi \u00f6zellikle vurguland\u0131. Bu ba\u011flamda i\u015f\u00e7inin g\u00f6revini ifa etmemesine binaen i\u015f s\u00f6zle\u015fmesinin hakl\u0131 nedenle feshinin g\u00fcndeme gelmesi halinde \u015fu ilkelerin g\u00f6z
