SGK uygulamas\u0131nda meslek hastal\u0131klar\u0131 di\u011fer hastal\u0131klardan tamamen farkl\u0131 i\u015flemlere tabi tutuluyor.<\/span><\/p>  <p><span class=\"large\"><strong>GEREKEN\u2008\u015eARTLAR<\/strong><\/span><\/p>  <p><span class=\"large\">Sigortal\u0131n\u0131n \u00e7al\u0131\u015ft\u0131\u011f\u0131 veya yapt\u0131\u011f\u0131 i\u015fin niteli\u011finden dolay\u0131 tekrarlanan bir sebeple veya i\u015fin y\u00fcr\u00fct\u00fcm \u015fartlar\u0131 y\u00fcz\u00fcnden u\u011frad\u0131\u011f\u0131 ge\u00e7ici veya s\u00fcrekli hastal\u0131k, bedensel veya ruhsal engellilik halleri nedeniyle SGK meslek hastal\u0131\u011f\u0131 sigortas\u0131ndan gelir<\/span><span class=\"large\">ve yard\u0131m yap\u0131yor. Bu yard\u0131mlar i\u00e7in SGK masraflar\u0131n\u0131 i\u015fverenlere r\u00fccu ettiriyor. \u00c7al\u0131\u015fan\u0131n i\u015fini ifas\u0131 esnas\u0131nda s\u00fcrekli tekrarlad\u0131\u011f\u0131 hareketlerinden veya yapt\u0131\u011f\u0131 i\u015fin niteli\u011fi, ortam\u0131 ya da i\u015fin y\u00fcr\u00fct\u00fcm \u015fartlar\u0131 nedeniyle mesle\u011fi ile ba\u011flant\u0131l\u0131 olarak meydana gelen hastal\u0131klar, mesleki risklerden kaynakl\u0131 hastal\u0131klard\u0131r.<\/span><\/p>  <p><span class=\"large\">Bu hastal\u0131\u011f\u0131n, bedensel veya ruhsal engellilik halinin y\u00fcr\u00fct\u00fclen i\u015fin sonucu olarak belirli bir zaman dilimi i\u00e7erisinde ortaya \u00e7\u0131kmas\u0131, uygun illiyet ba\u011f\u0131 bulunmas\u0131 gerekiyor.<\/span><\/p>  <p><span class=\"large\">Di\u011fer yandan meslek hastal\u0131\u011f\u0131 belirli bir zaman dilimi i\u00e7erisinde tekrarlanan bir sebeple, i\u015f kazas\u0131 ise aniden kaynaklanan bir sebeple ortaya \u00e7\u0131k\u0131yor.<\/span><\/p>  <p><span class=\"large\">Yap\u0131lan i\u015ften kaynakl\u0131 hastal\u0131klar genel olarak;<\/span><\/p>  <ul>   <li><span class=\"large\"> Kimyasal maddelerle olan meslek hastal\u0131klar\u0131<\/span><\/li>   <li><span class=\"large\"> Meslekicilt hastal\u0131klar\u0131<\/span><\/li>   <li><span class=\"large\"> Pn\u00f6mokonyozlarve di\u011fer meslekisolunum sistemi hastal\u0131klar\u0131<\/span><\/li>   <li><span class=\"large\"> Mesleki bula\u015f\u0131c\u0131 hastal\u0131klar ve<\/span><\/li>   <li><span class=\"large\"> Fiziki etkenlerle olan meslek hastal\u0131klar\u0131 olmak\u00fczere 5grupta yer al\u0131yor.<\/span><\/li>  <\/ul>  <p><strong style=\"font-size: 15.6px;\">SA\u011eLIK\u2008KURULU\u2008RAPORU<\/strong><\/p>  <p><span class=\"large\">Yap\u0131lani\u015ften dolay\u0131 vuku bulan hastal\u0131\u011f\u0131, sadece fiziksel olarak v\u00fccutta meydana gelen rahats\u0131zl\u0131klar\u0131 anlamamak gerekir. Psikolojik-ruhsal hastal\u0131klar da olabilir.<\/span><\/p>  <p><span class=\"large\">Sigortal\u0131n\u0131n \u00e7al\u0131\u015ft\u0131\u011f\u0131 i\u015ften dolay\u0131 meslek hastal\u0131\u011f\u0131na tutuldu\u011fu; SGK taraf\u0131ndan yetkilendirilen sa\u011fl\u0131k hizmet sunucular\u0131 taraf\u0131ndan usul\u00fcne uygun olarak d\u00fczenlenen sa\u011fl\u0131k kurulu raporu ve dayana\u011f\u0131 t\u0131bbi belgelerin incelenmesi sonucu SGK Sa\u011fl\u0131k Kurulu taraf\u0131ndan tespit edilmeli. Ayr\u0131ca hastal\u0131\u011f\u0131n \u2018\u00c7al\u0131\u015fma G\u00fcc\u00fc ve Meslekte Kazanma G\u00fcc\u00fc Kayb\u0131 Oran\u0131 Tespit \u0130\u015flemleri Y\u00f6netmeli\u011fi\u2019nde yer almas\u0131 ve SGK Sa\u011fl\u0131k Kurulunca maruziyet\/y\u00fck\u00fcml\u00fcl\u00fck s\u00fcrelerinin yeterli\/a\u015f\u0131lmam\u0131\u015f oldu\u011funun tespit edilmesi unsurlar\u0131n\u0131n bir arada ger\u00e7ekle\u015fmesi gerekiyor.<\/span><\/p>  <p><span class=\"large\">Meslek hastal\u0131\u011f\u0131, i\u015ften ayr\u0131ld\u0131ktan sonra ve sigortal\u0131 olarak \u00e7al\u0131\u015ft\u0131\u011f\u0131 i\u015ften kaynaklanm\u0131\u015f ise sigortal\u0131n\u0131n meslek hastal\u0131\u011f\u0131 sigortas\u0131ndan sa\u011flanan haklardan yararlanabilmesi i\u00e7in eski i\u015finden fiilen ayr\u0131lmas\u0131yla hastal\u0131\u011f\u0131n meydana \u00e7\u0131kmas\u0131 aras\u0131nda, bu hastal\u0131k i\u00e7in SGK taraf\u0131ndan \u00e7\u0131kar\u0131lan \u00c7al\u0131\u015fma G\u00fcc\u00fc ve Meslekte Kazanma G\u00fcc\u00fc Kayb\u0131 Oran\u0131 Tespit \u0130\u015flemleri Y\u00f6netmeli\u011fi\u2019nde belirtilen s\u00fcreden daha uzun bir zaman\u0131n ge\u00e7memi\u015f olmas\u0131 gerekiyor.<\/span><\/p>  <p><span class=\"large\">Ancak, sigortal\u0131n\u0131n herhangi bir meslek hastal\u0131\u011f\u0131n\u0131n klinik ve laboratuvar bulgular\u0131yla belirlendi\u011fi ve hastal\u0131\u011fa yol<\/span><span class=\"large\">a\u00e7an etkenin i\u015f yeri \u00e7al\u0131\u015fma \u015fartlar\u0131 nedeniyle meydana geldi\u011fi yap\u0131lan inceleme sonucunda tespit edildi\u011fi takdirde, meslek hastal\u0131klar\u0131 listesindeki y\u00fck\u00fcml\u00fcl\u00fck s\u00fcresi a\u015f\u0131lm\u0131\u015f olsa bile s\u00f6z konusu hastal\u0131\u011f\u0131n SGK\u2019n\u0131n tespiti veya ilgilinin ba\u015fvurusu \u00fczerine Sosyal Sigorta Y\u00fcksek Sa\u011fl\u0131k Kurulu\u2019nun onay\u0131 ile meslek hastal\u0131\u011f\u0131 say\u0131lmas\u0131 m\u00fcmk\u00fcn.<\/span><\/p>  <p><span class=\"large\"><strong>MADD\u0130 VE MANEV\u0130 TAZM\u0130NAT<\/strong><\/span><\/p>  <p><span class=\"large\">Meslek hastal\u0131klar\u0131na maruz kalan \u00e7al\u0131\u015fanlar, T\u00fcrk Bor\u00e7lar Kanunu\u2019nun ilgili h\u00fck\u00fcmlerine g\u00f6re i\u015fverenleri aleyhine maddi ve maddi tazminat davas\u0131 a\u00e7\u0131yor. \u0130\u015f\u00e7ilerin \u00f6l\u00fcm\u00fc halinde ise hak sahipleri yak\u0131nlar\u0131 destekten yoksun kalma tazminat\u0131 ile manevi tazminat davalar\u0131 a\u00e7abiliyor. Bu davalar sonucunda i\u015fverenler, SGK\u2019ya \u00f6deyecekleri r\u00fccu davalar\u0131 ve cezalar\u0131n\u0131n yan\u0131 s\u0131ra ayr\u0131ca y\u00fckl\u00fc miktarda tazminat \u00f6demekle kar\u015f\u0131 kar\u015f\u0131ya kal\u0131yor.<\/span><\/p>  <p><span class=\"large\"><strong>\u0130\u015eVERENE \u00d6DETT\u0130R\u0130L\u0130YOR<\/strong><\/span><\/p>  <p><span class=\"large\">Meslek hastal\u0131\u011f\u0131, i\u015fverenin kast\u0131 veya sigortal\u0131lar\u0131n sa\u011fl\u0131\u011f\u0131n\u0131 koruma ve i\u015f g\u00fcvenli\u011fi mevzuat\u0131na ayk\u0131r\u0131 bir hareketi sonucu meydana gelmi\u015fse, SGK taraf\u0131ndan sigortal\u0131ya veya hak sahiplerine yap\u0131lan veya ileride yap\u0131lmas\u0131 gereken t\u00fcm \u00f6demeler ile ba\u011flanan gelirin ba\u015flad\u0131\u011f\u0131 tarihteki ilk pe\u015fin sermaye de\u011feri toplam\u0131, sigortal\u0131 veya hak sahiplerinin i\u015fverenden isteyebilecekleri tutarlarla s\u0131n\u0131rl\u0131 olmak \u00fczere SGK taraf\u0131ndan i\u015fverene \u00f6dettiriliyor. Meslek hastal\u0131klar\u0131n\u0131n soru\u015fturmas\u0131 ve tefti\u015fi SGK m\u00fcfetti\u015fleri taraf\u0131ndan yap\u0131l\u0131yor. Ayr\u0131ca hastal\u0131\u011f\u0131n \u2018\u00c7al\u0131\u015fma G\u00fcc\u00fc ve Meslekte Kazanma G\u00fcc\u00fc Kayb\u0131 Oran\u0131 Tespit \u0130\u015flemleri Y\u00f6netmeli\u011fi\u2019nde yer almas\u0131 ve SGK Sa\u011fl\u0131k Kurulunca maruziyet\/y\u00fck\u00fcml\u00fcl\u00fck s\u00fcrelerinin yeterli\/a\u015f\u0131lmam\u0131\u015f oldu\u011funun tespit edilmesi unsurlar\u0131n\u0131n bir arada ger\u00e7ekle\u015fmesi gerekiyor.<\/span><\/p>  <p><span class=\"large\">Meslek hastal\u0131\u011f\u0131, i\u015ften ayr\u0131ld\u0131ktan sonra ve sigortal\u0131 olarak \u00e7al\u0131\u015ft\u0131\u011f\u0131 i\u015ften kaynaklanm\u0131\u015f ise sigortal\u0131n\u0131n meslek hastal\u0131\u011f\u0131 sigortas\u0131ndan sa\u011flanan haklardan yararlanabilmesi i\u00e7in eski i\u015finden fiilen ayr\u0131lmas\u0131yla hastal\u0131\u011f\u0131n meydana \u00e7\u0131kmas\u0131 aras\u0131nda, bu hastal\u0131k i\u00e7in SGK taraf\u0131ndan \u00e7\u0131kar\u0131lan \u00c7al\u0131\u015fma G\u00fcc\u00fc ve Meslekte Kazanma G\u00fcc\u00fc Kayb\u0131 Oran\u0131 Tespit \u0130\u015flemleri Y\u00f6netmeli\u011fi\u2019nde belirtilen s\u00fcreden daha uzun bir zaman\u0131n ge\u00e7memi\u015f olmas\u0131 gerekiyor.<\/span><\/p>  <p><span class=\"large\">Ancak, sigortal\u0131n\u0131n herhangi bir meslek hastal\u0131\u011f\u0131n\u0131n klinik ve laboratuvar bulgular\u0131yla belirlendi\u011fi ve hastal\u0131\u011fa yol<\/span><span class=\"large\">a\u00e7an etkenin i\u015f yeri \u00e7al\u0131\u015fma \u015fartlar\u0131 nedeniyle meydana geldi\u011fi yap\u0131lan inceleme sonucunda tespit edildi\u011fi takdirde, meslek hastal\u0131klar\u0131 listesindeki y\u00fck\u00fcml\u00fcl\u00fck s\u00fcresi a\u015f\u0131lm\u0131\u015f olsa bile s\u00f6z konusu hastal\u0131\u011f\u0131n SGK\u2019n\u0131n tespiti veya ilgilinin ba\u015fvurusu \u00fczerine Sosyal Sigorta Y\u00fcksek Sa\u011fl\u0131k Kurulu\u2019nun onay\u0131 ile meslek hastal\u0131\u011f\u0131 say\u0131lmas\u0131 m\u00fcmk\u00fcn.<\/span><\/p>  <p><span class=\"large\"><strong>MADD\u0130 VE MANEV\u0130 TAZM\u0130NAT<\/strong><\/span><\/p>  <p><span class=\"large\">Meslek hastal\u0131klar\u0131na maruz kalan \u00e7al\u0131\u015fanlar, T\u00fcrk Bor\u00e7lar Kanunu\u2019nun ilgili h\u00fck\u00fcmlerine g\u00f6re i\u015fverenleri aleyhine maddi ve maddi tazminat davas\u0131 a\u00e7\u0131yor. \u0130\u015f\u00e7ilerin \u00f6l\u00fcm\u00fc halinde ise hak sahipleri yak\u0131nlar\u0131 destekten yoksun kalma tazminat\u0131 ile manevi tazminat davalar\u0131 a\u00e7abiliyor. Bu davalar sonucunda i\u015fverenler, SGK\u2019ya \u00f6deyecekleri r\u00fccu davalar\u0131 ve cezalar\u0131n\u0131n yan\u0131 s\u0131ra ayr\u0131ca y\u00fckl\u00fc miktarda tazminat \u00f6demekle kar\u015f\u0131 kar\u015f\u0131ya kal\u0131yor.<\/span><\/p>  <p><span class=\"large\"><strong>\u0130\u015eVERENE \u00d6DETT\u0130R\u0130L\u0130YOR<\/strong><\/span><\/p>  <p><span class=\"large\">Meslek hastal\u0131\u011f\u0131, i\u015fverenin kast\u0131 veya sigortal\u0131lar\u0131n sa\u011fl\u0131\u011f\u0131n\u0131 koruma ve i\u015f g\u00fcvenli\u011fi mevzuat\u0131na ayk\u0131r\u0131 bir hareketi sonucu meydana gelmi\u015fse, SGK taraf\u0131ndan sigortal\u0131ya veya hak sahiplerine yap\u0131lan veya ileride yap\u0131lmas\u0131 gereken t\u00fcm \u00f6demeler ile ba\u011flanan gelirin ba\u015flad\u0131\u011f\u0131 tarihteki ilk pe\u015fin sermaye de\u011feri toplam\u0131, sigortal\u0131 veya hak sahiplerinin i\u015fverenden isteyebilecekleri tutarlarla s\u0131n\u0131rl\u0131 olmak \u00fczere SGK taraf\u0131ndan i\u015fverene \u00f6dettiriliyor. Meslek hastal\u0131klar\u0131n\u0131n soru\u015fturmas\u0131 ve tefti\u015fi SGK m\u00fcfetti\u015fleri taraf\u0131ndan yap\u0131l\u0131yor.
