Buna g\u00f6re i\u015fverenler, i\u015f yerinden ve yapt\u0131klar\u0131 i\u015ften kaynaklanan tehlike ve risklere kar\u015f\u0131 \u00e7al\u0131\u015fanlar\u0131n\u0131n sa\u011fl\u0131\u011f\u0131n\u0131 ve g\u00fcvenli\u011fini korumak zorunda.<\/span><\/p>  <p><span class=\"large\">Bu \u00e7er\u00e7evede i\u015fverenlerin mesleki risklerin \u00f6nlenmesi, e\u011fitim ve bilgi verilmesi dahil her t\u00fcrl\u00fc tedbirin al\u0131nmas\u0131, organizasyonun yap\u0131lmas\u0131, gerekli ara\u00e7 ve gere\u00e7lerin sa\u011flanmas\u0131, sa\u011fl\u0131k ve g\u00fcvenlik tedbirlerinin de\u011fi\u015fen \u015fartlara uygun hale getirilmesi i\u00e7in \u00e7al\u0131\u015fmalar yapmas\u0131 zorunlu. Ayr\u0131ca i\u015fveren, i\u015f yerindeki i\u015f sa\u011fl\u0131\u011f\u0131 ve g\u00fcvenli\u011fi tedbirlerine uyulup uyulmad\u0131\u011f\u0131n\u0131 izlemek, denetlemek ve uygunsuzluklar\u0131n giderilmesini sa\u011flamak, risk de\u011ferlendirmesi yapt\u0131rmak ve t\u00fcm \u00e7al\u0131\u015fanlara\u0130SG e\u011fitimi vermek zorunda. \u0130\u015fveren, belirtilen y\u00fck\u00fcml\u00fcl\u00fcklerden dolay\u0131 olu\u015fan maliyetleri de kendisi kar\u015f\u0131lamal\u0131. Bu maliyetleri \u00e7al\u0131\u015fanlara yans\u0131tamaz. \u0130\u015fverenin i\u015f sa\u011fl\u0131\u011f\u0131 ve g\u00fcvenli\u011fi mevzuat\u0131ndan kaynaklanan y\u00fck\u00fcml\u00fcl\u00fckleri yerine getirmemesi halinde a\u011f\u0131r idari para cezas\u0131 uygulan\u0131yor.<\/span><\/p>  <p><span class=\"large\">\u0130\u015f sa\u011fl\u0131\u011f\u0131 ve g\u00fcvenli\u011fi mevzuat\u0131m\u0131zdasadece i\u015fverenlere de\u011fil, \u00e7al\u0131\u015fanlara da birtak\u0131m y\u00fck\u00fcml\u00fcl\u00fck ve sorumluluklar \u00f6ng\u00f6r\u00fcl\u00fcyor.<\/span><\/p>  <p><span class=\"large\">\u0130nceleme konusu bu emsal nitelikteki Yarg\u0131tay karar\u0131nda, \u00e7al\u0131\u015fanlar\u0131n i\u015f g\u00fcvenli\u011fine ili\u015fkin tedbirlere hangi durumlarda uymamalar\u0131 halinde i\u015fveren a\u00e7\u0131s\u0131ndan hakl\u0131 fesih sebep te\u015fkil edip etmeyece\u011fi de\u011ferlendirildi.<\/span><\/p>  <p><span class=\"large\">Karar\u0131 veren daire: Yarg\u0131tay 9. Hukuk Dairesi<\/span><br><span class=\"large\"> Esas no: 2017\/863 <\/span><br><span class=\"large\"> Karar no: 2020\/14156<\/span><\/p>  <p><span class=\"large\"><strong>YASAL DAYANAK<\/strong><\/span><\/p>  <p><span class=\"large\">4857 say\u0131l\u0131 kanunun 25\/II- \u0131 maddesine g\u00f6re, \u201c\u0130\u015f\u00e7inin kendi iste\u011fi veya savsaklamas\u0131 y\u00fcz\u00fcndeni\u015fin g\u00fcvenli\u011fini tehlikeye d\u00fc\u015f\u00fcrmesi\u2026\u201d h\u00fckm\u00fc amirdir.<\/span><\/p>  <p><span class=\"large\">\u0130nceleme konusu Yarg\u0131tay karar\u0131nda; davac\u0131 vekili, m\u00fcvekkilinin, 19 Kas\u0131m 2015 tarihinde i\u015f akdinin haks\u0131z ve tek tarafl\u0131 olarak sonland\u0131r\u0131ld\u0131\u011f\u0131n\u0131, i\u015f akdinin feshinden sonra k\u0131dem ve ihbar tazminat\u0131n\u0131n \u00f6denmedi\u011fini ileri s\u00fcrerek, k\u0131dem ve ihbar tazminatlar\u0131<\/span><span class=\"large\">ile y\u0131ll\u0131k izin ve ulusal bayram genel tatil alacaklar\u0131n\u0131n daval\u0131dan tahsilini talep etti.<\/span><\/p>  <p><span class=\"large\"><strong>\u0130\u015eVEREN\u0130N YANITI<\/strong><\/span><\/p>  <p><span class=\"large\">Daval\u0131n\u0131n cevab\u0131 ise \u00f6zetle \u015f\u00f6yle: \u201cDavac\u0131, \u00e7al\u0131\u015fma hayat\u0131 boyunca \u00e7ok say\u0131da hata yapt\u0131, disiplin kurallar\u0131na uymad\u0131. Bu hatalar\u0131 sebebiyle hakk\u0131nda tutanaklar tutuldu, savunmas\u0131 istendi ve disiplin cezas\u0131 verildi. \u0130\u015f g\u00fcvenli\u011fini tehlikeye sokmak fiili, cezay\u0131 gerektiren haller aras\u0131nda ve bunun m\u00fceyyidesi de i\u015f yeri disiplin y\u00f6netmeli\u011fi gere\u011fince bildirimsiz fesih. Davac\u0131n\u0131n i\u015f s\u00f6zle\u015fmesinin feshi hakl\u0131 nedene dayan\u0131yor. Davac\u0131, y\u0131ll\u0131k izinlerini kulland\u0131, ulusal bayram genel tatil \u00fccretlerinin \u00f6dendi\u011fine dair imzal\u0131 \u00fccret bordrolar\u0131 mevcut. Dava konusu alacaklar\u0131 talep hakk\u0131 bulunmad\u0131\u011f\u0131n\u0131 savunarak davan\u0131n reddini talep ediyoruz.\u201d<\/span><\/p>  <p><span class=\"large\"><strong>\u00c7ALI\u015eANIN Y\u00dcK\u00dcML\u00dcL\u00dcKLER\u0130<\/strong><\/span><\/p>  <p><span class=\"large\">Yarg\u0131tay 9. Hukuk Dairesi\u2019nin konuyla ilgili karar\u0131nda \u015f\u00f6yle denildi: \u201cYerel mahkemece davan\u0131n k\u0131smen kabul\u00fc ile k\u0131dem ve ihbar tazminatlar\u0131 ile ulusal bayram genel tatil alacaklar\u0131n\u0131n daval\u0131dan tahsiline h\u00fckmedilmesine kar\u015f\u0131 daval\u0131 vekili taraf\u0131ndan Yarg\u0131tay\u2019a intikal ettirilen olayda, belirtilen Daire karar\u0131nda;<\/span><\/p>  <p><span class=\"large\">6331 say\u0131l\u0131 \u0130\u015f Sa\u011fl\u0131\u011f\u0131 ve G\u00fcvenli\u011fi Kanunu\u2019nun 19. maddesinde a\u00e7\u0131k\u00e7a belirtildi\u011fi \u00fczere;<\/span><\/p>  <p><span class=\"large\">1. \u00c7al\u0131\u015fanlar, i\u015f sa\u011fl\u0131\u011f\u0131 ve g\u00fcvenli\u011fi ile ilgili ald\u0131klar\u0131 e\u011fitim ve i\u015fverenin bu konudaki talimatlar\u0131 do\u011frultusunda, kendilerinin ve di\u011fer \u00e7al\u0131\u015fanlar\u0131n sa\u011fl\u0131k ve g\u00fcvenliklerini tehlikeye d\u00fc\u015f\u00fcrmemekle y\u00fck\u00fcml\u00fcd\u00fcr.<\/span><\/p>  <p><span class=\"large\">2. \u00c7al\u0131\u015fanlar\u0131n, i\u015fveren taraf\u0131ndan verilen e\u011fitim ve talimatlar do\u011frultusunda y\u00fck\u00fcml\u00fcl\u00fckleri \u015funlard\u0131r:<\/span><\/p>  <p><span class=\"large\">a. \u0130\u015fyerindeki makina, cihaz, ara\u00e7, gere\u00e7, tehlikeli madde, ta\u015f\u0131ma ekipman\u0131 ve di\u011fer \u00fcretim ara\u00e7lar\u0131n\u0131 kurallara uygun \u015fekilde kullanmak, bunlar\u0131n g\u00fcvenlik donan\u0131mlar\u0131n\u0131 do\u011fru olarak kullanmak, keyfi olarak \u00e7\u0131karmamak ve de\u011fi\u015ftirmemek.<\/span><\/p>  <p><span class=\"large\">b. Kendilerine sa\u011flanan ki\u015fisel koruyucu donan\u0131m\u0131 do\u011fru kullanmak ve korumak.<\/span><\/p>  <p><span class=\"large\">c. \u0130\u015fyerindeki makina, cihaz, ara\u00e7, gere\u00e7, tesis ve binalarda sa\u011fl\u0131k ve g\u00fcvenlik y\u00f6n\u00fcnden ciddi ve yak\u0131n bir tehlike ile kar\u015f\u0131la\u015ft\u0131klar\u0131nda ve koruma tedbirlerinde bir eksiklik g\u00f6rd\u00fcklerinde, i\u015fverene veya \u00e7al\u0131\u015fan temsilcisine derhal haber vermek.<\/span><\/p>  <p><span class=\"large\">\u00e7. \u0130\u015fyerinde tespit edilen noksanl\u0131k ve mevzuata ayk\u0131r\u0131l\u0131klar\u0131n giderilmesi konusunda, i\u015fveren ve \u00e7al\u0131\u015fan temsilcisi ile i\u015fbirli\u011fi yapmak.<\/span><\/p>  <p><span class=\"large\">d. Kendi g\u00f6rev alan\u0131nda, i\u015f sa\u011fl\u0131\u011f\u0131 ve g\u00fcvenli\u011finin sa\u011flanmas\u0131 i\u00e7in i\u015fveren ve \u00e7al\u0131\u015fan temsilcisi ile i\u015fbirli\u011fi yapmak zorundad\u0131r. \u0130\u015f\u00e7i, i\u015f g\u00fcvenli\u011fini tehlikeye d\u00fc\u015f\u00fcr\u00fcc\u00fc her t\u00fcrl\u00fc davran\u0131\u015ftan ka\u00e7\u0131nmak zorundad\u0131r.<\/span><\/p>  <p><span class=\"large\">4857 say\u0131l\u0131 yasan\u0131n 25\/II-(\u0131) maddesine g\u00f6re \u2018\u0130\u015f\u00e7inin kendi iste\u011fi veya savsaklamas\u0131 y\u00fcz\u00fcndeni\u015fin g\u00fcvenli\u011fini tehlikeye d\u00fc\u015f\u00fcrmesi\u2019, i\u015fveren a\u00e7\u0131s\u0131ndan hakl\u0131 fesih sebebidir. Somut uyu\u015fmazl\u0131k bu yasal d\u00fczenlemelere ve a\u00e7\u0131klamalara g\u00f6re de\u011ferlendirildi\u011finde;<\/span><span class=\"large\">dosya i\u00e7eri\u011fi, i\u015fverence tutulan tutanaklar ve tan\u0131k beyanlar\u0131na g\u00f6re davac\u0131n\u0131n daval\u0131 i\u015fyerinde de\u011firmen kat\u0131nda \u00e7al\u0131\u015ft\u0131\u011f\u0131, i\u015f g\u00fcvenli\u011fi talimat ve tutana\u011f\u0131na g\u00f6re i\u015fyerinde baret takman\u0131n gerekli oldu\u011fu, davac\u0131n\u0131n baret takmad\u0131\u011f\u0131 anla\u015f\u0131lm\u0131\u015ft\u0131r. Daval\u0131 i\u015fveren taraf\u0131ndan davac\u0131n\u0131n i\u015f s\u00f6zle\u015fmesi, \u0130\u015f Kanunu\u2019nun 25\/II-(\u0131) maddesi uyar\u0131nca s\u00fcresi i\u00e7inde derhal sona erdirilmi\u015ftir. Buna g\u00f6re daval\u0131n\u0131n i\u015f s\u00f6zle\u015fmesini hakl\u0131 nedenle feshetti\u011finin kabul\u00fc ile davac\u0131n\u0131n k\u0131dem ve ihbar tazminat\u0131 taleplerinin reddi gerekirken yerinde olmayan gerek\u00e7e ile kabul\u00fc hatal\u0131d\u0131r.\u201d<\/span><\/p>  <p><span class=\"large\"><strong>\u0130\u015eVEREN KURALLARI NET BEL\u0130RLEMEL\u0130<\/strong><\/span><\/p>  <p><span class=\"large\">\u0130\u015f sa\u011fl\u0131\u011f\u0131 ve g\u00fcvenli\u011fi kurallar\u0131na uymayan i\u015f\u00e7ilerin tazminats\u0131z i\u015ften \u00e7\u0131kar\u0131lmalar\u0131, i\u015fveren a\u00e7\u0131s\u0131ndan hakl\u0131 sebep olarak g\u00f6r\u00fcl\u00fcyor. Bunun i\u00e7in \u00f6ncelikle i\u015f\u00e7ilere i\u015f sa\u011fl\u0131\u011f\u0131 ve g\u00fcvenli\u011fi ile ilgili \u00f6ng\u00f6r\u00fclen e\u011fitim ve ki\u015fisel koruyucular\u0131n verilmesi, i\u015fverenin de y\u00fck\u00fcml\u00fcl\u00fcklerinin mevzuata uygun hale getirilmesi elzemdir. Bu maliyetleri \u00e7al\u0131\u015fanlara yans\u0131tamaz. \u0130\u015fverenin i\u015f sa\u011fl\u0131\u011f\u0131 ve g\u00fcvenli\u011fi mevzuat\u0131ndan kaynaklanan y\u00fck\u00fcml\u00fcl\u00fckleri yerine getirmemesi halinde a\u011f\u0131r idari para cezas\u0131 uygulan\u0131yor.<\/span><\/p>  <p><span class=\"large\">\u0130\u015f sa\u011fl\u0131\u011f\u0131 ve g\u00fcvenli\u011fi mevzuat\u0131m\u0131zdasadece i\u015fverenlere de\u011fil, \u00e7al\u0131\u015fanlara da birtak\u0131m y\u00fck\u00fcml\u00fcl\u00fck ve sorumluluklar \u00f6ng\u00f6r\u00fcl\u00fcyor.<\/span><\/p>  <p><span class=\"large\">\u0130nceleme konusu bu emsal nitelikteki Yarg\u0131tay karar\u0131nda, \u00e7al\u0131\u015fanlar\u0131n i\u015f g\u00fcvenli\u011fine ili\u015fkin tedbirlere hangi durumlarda uymamalar\u0131 halinde i\u015fveren a\u00e7\u0131s\u0131ndan hakl\u0131 fesih sebep te\u015fkil edip etmeyece\u011fi de\u011ferlendirildi.<\/span><\/p>  <p><span class=\"large\">Karar\u0131 veren daire: Yarg\u0131tay 9. Hukuk Dairesi<\/span><br><span class=\"large\"> Esas no: 2017\/863 <\/span><br><span class=\"large\"> Karar no: 2020\/14156<\/span><\/p>  <p><span class=\"large\"><strong>YASAL DAYANAK<\/strong><\/span><\/p>  <p><span class=\"large\">4857 say\u0131l\u0131 kanunun 25\/II- \u0131 maddesine g\u00f6re, \u201c\u0130\u015f\u00e7inin kendi iste\u011fi veya savsaklamas\u0131 y\u00fcz\u00fcndeni\u015fin g\u00fcvenli\u011fini tehlikeye d\u00fc\u015f\u00fcrmesi\u2026\u201d h\u00fckm\u00fc amirdir.<\/span><\/p>  <p><span class=\"large\">\u0130nceleme konusu Yarg\u0131tay karar\u0131nda; davac\u0131 vekili, m\u00fcvekkilinin, 19 Kas\u0131m 2015 tarihinde i\u015f akdinin haks\u0131z ve tek tarafl\u0131 olarak sonland\u0131r\u0131ld\u0131\u011f\u0131n\u0131, i\u015f akdinin feshinden sonra k\u0131dem ve ihbar tazminat\u0131n\u0131n \u00f6denmedi\u011fini ileri s\u00fcrerek, k\u0131dem ve ihbar tazminatlar\u0131<\/span><span class=\"large\">ile y\u0131ll\u0131k izin ve ulusal bayram genel tatil alacaklar\u0131n\u0131n daval\u0131dan tahsilini talep etti.<\/span><\/p>  <p><span class=\"large\"><strong>\u0130\u015eVEREN\u0130N YANITI<\/strong><\/span><\/p>  <p><span class=\"large\">Daval\u0131n\u0131n cevab\u0131 ise \u00f6zetle \u015f\u00f6yle: \u201cDavac\u0131, \u00e7al\u0131\u015fma hayat\u0131 boyunca \u00e7ok say\u0131da hata yapt\u0131, disiplin kurallar\u0131na uymad\u0131. Bu hatalar\u0131 sebebiyle hakk\u0131nda tutanaklar tutuldu, savunmas\u0131 istendi ve disiplin cezas\u0131 verildi. \u0130\u015f g\u00fcvenli\u011fini tehlikeye sokmak fiili, cezay\u0131 gerektiren haller aras\u0131nda ve bunun m\u00fceyyidesi de i\u015f yeri disiplin y\u00f6netmeli\u011fi gere\u011fince bildirimsiz fesih. Davac\u0131n\u0131n i\u015f s\u00f6zle\u015fmesinin feshi hakl\u0131 nedene dayan\u0131yor. Davac\u0131, y\u0131ll\u0131k izinlerini kulland\u0131, ulusal bayram genel tatil \u00fccretlerinin \u00f6dendi\u011fine dair imzal\u0131 \u00fccret bordrolar\u0131 mevcut. Dava konusu alacaklar\u0131 talep hakk\u0131 bulunmad\u0131\u011f\u0131n\u0131 savunarak davan\u0131n reddini talep ediyoruz.\u201d<\/span><\/p>  <p><span class=\"large\"><strong>\u00c7ALI\u015eANIN Y\u00dcK\u00dcML\u00dcL\u00dcKLER\u0130<\/strong><\/span><\/p>  <p><span class=\"large\">Yarg\u0131tay 9. Hukuk Dairesi\u2019nin konuyla ilgili karar\u0131nda \u015f\u00f6yle denildi: \u201cYerel mahkemece davan\u0131n k\u0131smen kabul\u00fc ile k\u0131dem ve ihbar tazminatlar\u0131 ile ulusal bayram genel tatil alacaklar\u0131n\u0131n daval\u0131dan tahsiline h\u00fckmedilmesine kar\u015f\u0131 daval\u0131 vekili taraf\u0131ndan Yarg\u0131tay\u2019a intikal ettirilen olayda, belirtilen Daire karar\u0131nda;<\/span><\/p>  <p><span class=\"large\">6331 say\u0131l\u0131 \u0130\u015f Sa\u011fl\u0131\u011f\u0131 ve G\u00fcvenli\u011fi Kanunu\u2019nun 19. maddesinde a\u00e7\u0131k\u00e7a belirtildi\u011fi \u00fczere;<\/span><\/p>  <p><span class=\"large\">1. \u00c7al\u0131\u015fanlar, i\u015f sa\u011fl\u0131\u011f\u0131 ve g\u00fcvenli\u011fi ile ilgili ald\u0131klar\u0131 e\u011fitim ve i\u015fverenin bu konudaki talimatlar\u0131 do\u011frultusunda, kendilerinin ve di\u011fer \u00e7al\u0131\u015fanlar\u0131n sa\u011fl\u0131k ve g\u00fcvenliklerini tehlikeye d\u00fc\u015f\u00fcrmemekle y\u00fck\u00fcml\u00fcd\u00fcr.<\/span><\/p>  <p><span class=\"large\">2. \u00c7al\u0131\u015fanlar\u0131n, i\u015fveren taraf\u0131ndan verilen e\u011fitim ve talimatlar do\u011frultusunda y\u00fck\u00fcml\u00fcl\u00fckleri \u015funlard\u0131r:<\/span><\/p>  <p><span class=\"large\">a. \u0130\u015fyerindeki makina, cihaz, ara\u00e7, gere\u00e7, tehlikeli madde, ta\u015f\u0131ma ekipman\u0131 ve di\u011fer \u00fcretim ara\u00e7lar\u0131n\u0131 kurallara uygun \u015fekilde kullanmak, bunlar\u0131n g\u00fcvenlik donan\u0131mlar\u0131n\u0131 do\u011fru olarak kullanmak, keyfi olarak \u00e7\u0131karmamak ve de\u011fi\u015ftirmemek.<\/span><\/p>  <p><span class=\"large\">b. Kendilerine sa\u011flanan ki\u015fisel koruyucu donan\u0131m\u0131 do\u011fru kullanmak ve korumak.<\/span><\/p>  <p><span class=\"large\">c. \u0130\u015fyerindeki makina, cihaz, ara\u00e7, gere\u00e7, tesis ve binalarda sa\u011fl\u0131k ve g\u00fcvenlik y\u00f6n\u00fcnden ciddi ve yak\u0131n bir tehlike ile kar\u015f\u0131la\u015ft\u0131klar\u0131nda ve koruma tedbirlerinde bir eksiklik g\u00f6rd\u00fcklerinde, i\u015fverene veya \u00e7al\u0131\u015fan temsilcisine derhal haber vermek.<\/span><\/p>  <p><span class=\"large\">\u00e7. \u0130\u015fyerinde tespit edilen noksanl\u0131k ve mevzuata ayk\u0131r\u0131l\u0131klar\u0131n giderilmesi konusunda, i\u015fveren ve \u00e7al\u0131\u015fan temsilcisi ile i\u015fbirli\u011fi yapmak.<\/span><\/p>  <p><span class=\"large\">d. Kendi g\u00f6rev alan\u0131nda, i\u015f sa\u011fl\u0131\u011f\u0131 ve g\u00fcvenli\u011finin sa\u011flanmas\u0131 i\u00e7in i\u015fveren ve \u00e7al\u0131\u015fan temsilcisi ile i\u015fbirli\u011fi yapmak zorundad\u0131r. \u0130\u015f\u00e7i, i\u015f g\u00fcvenli\u011fini tehlikeye d\u00fc\u015f\u00fcr\u00fcc\u00fc her t\u00fcrl\u00fc davran\u0131\u015ftan ka\u00e7\u0131nmak zorundad\u0131r.<\/span><\/p>  <p><span class=\"large\">4857 say\u0131l\u0131 yasan\u0131n 25\/II-(\u0131) maddesine g\u00f6re \u2018\u0130\u015f\u00e7inin kendi iste\u011fi veya savsaklamas\u0131 y\u00fcz\u00fcndeni\u015fin g\u00fcvenli\u011fini tehlikeye d\u00fc\u015f\u00fcrmesi\u2019, i\u015fveren a\u00e7\u0131s\u0131ndan hakl\u0131 fesih sebebidir. Somut uyu\u015fmazl\u0131k bu yasal d\u00fczenlemelere ve a\u00e7\u0131klamalara g\u00f6re de\u011ferlendirildi\u011finde;<\/span><span class=\"large\">dosya i\u00e7eri\u011fi, i\u015fverence tutulan tutanaklar ve tan\u0131k beyanlar\u0131na g\u00f6re davac\u0131n\u0131n daval\u0131 i\u015fyerinde de\u011firmen kat\u0131nda \u00e7al\u0131\u015ft\u0131\u011f\u0131, i\u015f g\u00fcvenli\u011fi talimat ve tutana\u011f\u0131na g\u00f6re i\u015fyerinde baret takman\u0131n gerekli oldu\u011fu, davac\u0131n\u0131n baret takmad\u0131\u011f\u0131 anla\u015f\u0131lm\u0131\u015ft\u0131r. Daval\u0131 i\u015fveren taraf\u0131ndan davac\u0131n\u0131n i\u015f s\u00f6zle\u015fmesi, \u0130\u015f Kanunu\u2019nun 25\/II-(\u0131) maddesi uyar\u0131nca s\u00fcresi i\u00e7inde derhal sona erdirilmi\u015ftir. Buna g\u00f6re daval\u0131n\u0131n i\u015f s\u00f6zle\u015fmesini hakl\u0131 nedenle feshetti\u011finin kabul\u00fc ile davac\u0131n\u0131n k\u0131dem ve ihbar tazminat\u0131 taleplerinin reddi gerekirken yerinde olmayan gerek\u00e7e ile kabul\u00fc hatal\u0131d\u0131r.\u201d<\/span><\/p>  <p><span class=\"large\"><strong>\u0130\u015eVEREN KURALLARI NET BEL\u0130RLEMEL\u0130<\/strong><\/span><\/p>  <p><span class=\"large\">\u0130\u015f sa\u011fl\u0131\u011f\u0131 ve g\u00fcvenli\u011fi kurallar\u0131na uymayan i\u015f\u00e7ilerin tazminats\u0131z i\u015ften \u00e7\u0131kar\u0131lmalar\u0131, i\u015fveren a\u00e7\u0131s\u0131ndan hakl\u0131 sebep olarak g\u00f6r\u00fcl\u00fcyor. Bunun i\u00e7in \u00f6ncelikle i\u015f\u00e7ilere i\u015f sa\u011fl\u0131\u011f\u0131 ve g\u00fcvenli\u011fi ile ilgili \u00f6ng\u00f6r\u00fclen e\u011fitim ve ki\u015fisel koruyucular\u0131n verilmesi, i\u015fverenin de y\u00fck\u00fcml\u00fcl\u00fcklerinin mevzuata uygun hale getirilmesi elzemdir.
