Kay\u0131td\u0131\u015f\u0131 istihdam, genelde kamu maliyesini \u00f6zelde ise en fazla SGK\u2019y\u0131 olumsuz y\u00f6nde etkiliyor. Bu etkilerin \u00f6zel sekt\u00f6r i\u015fletmelerine yans\u0131yan en olumsuz y\u00f6n\u00fc ise haks\u0131z rekabet \u015feklinde ortaya \u00e7\u0131k\u0131yor. Kay\u0131td\u0131\u015f\u0131 istihdam, SGK\u2019ya sadece \u00e7al\u0131\u015fanlar\u0131n SGK\u2019ya bildirilmemesi \u015feklinde ortaya \u00e7\u0131km\u0131yor. Bildirilen \u00e7al\u0131\u015fanlar\u0131n \u00fccret veya g\u00fcn say\u0131lar\u0131n\u0131n eksik bildirilmesi \u015feklinde de ortaya \u00e7\u0131k\u0131yor. \u0130\u015fte buna \u00e7\u00f6z\u00fcm bulmak i\u00e7in ilk defa 1999\u2019da y\u00fcr\u00fcrl\u00fc\u011fe giren 4447 say\u0131l\u0131 Kanunla I. Sosyal G\u00fcvenlik Reformu\u2019nun yap\u0131ld\u0131\u011f\u0131 d\u00fczenlemelerle \u00e7\u00f6z\u00fcm \u00fcretilmeye \u00e7al\u0131\u015f\u0131ld\u0131.<\/span><\/p>  <p><span class=\"large\">O d\u00f6nemde SSK\u2019n\u0131n buldu\u011fu \u00e7\u00f6z\u00fcm, eksik g\u00fcn nedeninin i\u015fverenlerce ispatlanmas\u0131 \u015feklinde oldu. Bu uygulama daha da geli\u015ftirilerek SGK mevzuat\u0131nda da yer ald\u0131. SGK eksik g\u00fcn nedeni uygulamas\u0131 hem y\u00f6netmelik de\u011fi\u015fikli\u011fi hem de yeni Torba Kanunu\u2019nda yeniden d\u00fczenlendi.<\/span><\/p>  <p><span class=\"large\"><strong>EKS\u0130K G\u00dcN B\u0130LD\u0130R\u0130M FORMU<\/strong><\/span><\/p>  <p><span class=\"large\">SGK uygulamas\u0131nda ayl\u0131k prim ve hizmet belgesi ile birlikte ay i\u00e7inde 30 g\u00fcnden az \u00e7al\u0131\u015fan veya eksik \u00fccret \u00f6denen sigortal\u0131lara ili\u015fkin verilmesi gereken eksik g\u00fcn bildirim formu uygulamas\u0131n\u0131n kapsam\u0131 zamanla yap\u0131lan de\u011fi\u015fikliklerle gittik\u00e7e daralt\u0131ld\u0131.<\/span><\/p>  <p><span class=\"large\">Mevcut uygulamada; genel b\u00fct\u00e7eye dahil dairelerin, \u00f6zel b\u00fct\u00e7eli idarelerin, d\u00f6ner sermayelerin, fonlar\u0131n, belediyelerin, il \u00f6zel idarelerinin, belediyeler ve il \u00f6zel idareleri taraf\u0131ndan kurulan birlik ve i\u015fletmelerin, b\u00fct\u00e7eden yard\u0131m alan kurulu\u015flar ile \u00f6zel kanunla kurulmu\u015f di\u011fer kamu kurum, kurul, \u00fcst kurul ve kurulu\u015flar\u0131n, kamu iktisadi te\u015febb\u00fcslerinin ve bunlar\u0131n ba\u011fl\u0131 ortakl\u0131klar\u0131 ile m\u00fcessese ve i\u015fletmelerinde ve sermayesinin y\u00fczde 50\u2019sinden fazlas\u0131 kamuya ait olan di\u011fer ortakl\u0131klar\u0131n\u0131n, kamu kurumu niteli\u011findeki meslek kurulu\u015flar\u0131n\u0131n ve \u00fcst kurulu\u015flar\u0131n\u0131n, sendikalar\u0131n, vak\u0131flar\u0131n, bankac\u0131l\u0131k kanunu kapsam\u0131ndaki kurulu\u015flar\u0131n i\u015fyerleri ve toplu i\u015f s\u00f6zle\u015fmesi yap\u0131lan i\u015fyerleri ile10ve \u00fczerinde sigortal\u0131n\u0131n \u00e7al\u0131\u015ft\u0131r\u0131ld\u0131\u011f\u0131 aylara ili\u015fkin \u00f6zel sekt\u00f6r i\u015fyerlerinde eksik g\u00fcn bildirim nedenlerinin ayl\u0131k prim ve hizmet belgesinde belirtilmesi yeterli bulunuyor.<\/span><\/p>  <p><span class=\"large\">Bu i\u015fyerleri i\u00e7in ayr\u0131ca eksik g\u00fcn bildirim formu ile eki belgeler aranm\u0131yor.<\/span><\/p>  <p><span class=\"large\"><strong>10\u2019DAN AZ \u0130\u015e\u00c7\u0130 \u00c7ALI\u015eTIRANLAR D\u0130KKAT <\/strong><\/span><\/p>  <p><span class=\"large\">Y\u00f6netmelik de\u011fi\u015fikli\u011fi ile ay i\u00e7inde 30 g\u00fcnden az \u00e7al\u0131\u015fan veya eksik \u00fccret \u00f6denen sigortal\u0131lara ili\u015fkin SGK taraf\u0131ndan istenen belgeler yeniden d\u00fczenlendi. Kanunun ek 76 ve ge\u00e7ici 192\u2019nci maddesine tabi olundu\u011funu g\u00f6sterir belge<\/span><br><span class=\"large\"><strong> i)<\/strong> Yar\u0131m \u00e7al\u0131\u015fma \u00f6dene\u011fi al\u0131nd\u0131\u011f\u0131na dair ilgili resm\u00ee makamlardan al\u0131nan belge<\/span><br><span class=\"large\"><strong> j)<\/strong> \u0130SG-KAT\u0130P \u00fczerinden al\u0131nan s\u00f6zle\u015fmeler<\/span><br><span class=\"large\"><strong> k)<\/strong> Sonradan d\u00fczenlenebilir niteli\u011finde olmayan benzer nitelikteki belgeler.<\/span><\/p>  <p><span class=\"large\">Bunlardan, (a), (c), (\u00e7), (f), (h), (\u0131), (i), (j) ve (k) maddelerinde say\u0131lan belgeler Kuruma verilmez. Ancak s\u00f6z konusu belgelerin Kurumca istenilmesi halinde ibraz edilmek \u00fczere i\u015fverence saklanmas\u0131 gerekiyor. \u0130lgili belgelerin Kurumca talep edilmesine ra\u011fmen ibraz edilmemesi halinde SGK taraf\u0131ndan re\u2019sen i\u015flem yap\u0131larak muhteviyat\u0131 primler gecikme zamm\u0131 ve cezas\u0131 ile birlikte i\u015fverenden al\u0131n\u0131yor.<\/span><\/p>  <p><span class=\"large\"><strong>TORBA TASARIDA DA D\u00dcZENLEME VAR <\/strong><\/span><\/p>  <p><span class=\"large\">Halen TBMM\u2019de bulunan Torba Kanun tasar\u0131s\u0131nda, eksik g\u00fcn bildirimine ili\u015fkin de\u011fi\u015fiklikler \u00f6ng\u00f6r\u00fcl\u00fcyor.
